Fired from a family business

I have worked for my father's business for almost 15 years. Recently he fired me over a personal grievance, not work related.

When I filed for unemployment there were questions about working for family and how close the family member was to me.

I received paperwork in the mail asking for more specific details about who fired me, why they fired me and if I had been written up on performance/work issues during my employment. I have never been written up in all my time employed by him.

Will I get approved for unemployment? I'm very nervous about not qualifying because I don't have savings and this is a really scary time financially for me.

Very scary to be back in the market for a job in my mid 40s. Terrifying actually.

After waiting period , help

Hey all , I work for a company that’s on break for the summer . I was receiving my Unemployment benefits but last week I had to recertify as my benefit year ended . Received a letter saying my amount is raised . Last week I claimed which was my waiting week , this week on Sunday I claimed and the website isn’t showing any release of funds other than the waiting period . Anybody happen to know how long it’ll take for funds and website to release ?

Filing a claim HELP

Hi! I applied for benefits for the first time and received this message

"Your claim cannot be processed in New York as your wages were reported to another state. Please contact the state where your wages were reported. You may need to contact your employer to determine the state where they reported your wages. If you believe this is incorrect, you may file your claim by telephone at 1-888-209-8124."

I have only worked in NY and my job reported my wages in NY. Does anyone have recent experience with getting this message? Does anyone have recent experience with getting someone on the phone from Unemployment? The Governors office number does not work :(

So bummed / do you think there is any hope still?

So I just got a letter saying that I don't qualify for unemployment because

1 - I did not earn wages in at least 2 calendar quarters of my base period
2- The total wages of my base period are less that 1.5 times the total wages for the highest quarter earnings in your base period

So for context, I stared a job in November last year, and was fired mid June this year. I was first sent a letter saying that I did not qualify because they only had my wage info for 1 BASIC BASE QUARTER 10/1 – 12/31, and I filed for reconsideration using the ALTERNATE BASE QUARTER option 1/1 - 3/31, and supplied the wage information of the rest of time leading up to my termination. But just got a letter saying that I still don't quality, stating the 2 reasons I listed above.

I was just looking on the FAQ page, and had a little glimmer of hope and saw this:

If you do not qualify in any of these base periods,
AND
You worked for pay in the calendar quarter when you filed,
AND
You are still unemployed after that quarter ends,
AND
You think that you may qualify using the latest work,
THEN
You should file a claim again for benefits after this calendar quarter ends.
Please note:
Once you use wages to establish a claim, they are void for the next claim. You cannot use them again. This may affect your entitlement to a later claim.

So does this mean I can reapply, since we are now in August, and I am indeed still unemployed. Or does this note:

Once you use wages to establish a claim, they are void for the next claim. You cannot use them again. This may affect your entitlement to a later claim.

mean that I can't qualify because I've already used these wages on this claim? Which fucking sucks and seems so unfair :,(

What happens if I didn’t complete three work search activities in a week?

Hi guys, I’ve been on unemployment in NYC for a few weeks and went to certify for the period of 8/1-8/8 today and realized when checking my records I think I only completed one work search activity last week. There was a lot going on with family, a death in the family (second in less than a month) apartment issues, travel issues and I must’ve not gone back to complete the other two when it started to get crazy. I went to file my claim but it doesn’t have an option to honestly report that. I don’t want to fraud them and cause myself to lose benefits overall, and I understand if I don’t receive payment for that week — I just want to be honest to not cause issues. I cannot get through to someone over the phone. Does anyone know what to do in this situation? Thank you!

Constructive Discharge timeline

After a prolonged constructive discharge, where I was careful to give the employer multiple chances to make the situation right (and documented everything), I submitted for UI after I resigned. I faxed back the questionnaire and request for reconsideration DOL sent me within 3 business days. Now it’s been almost 2 calendar weeks and I haven’t heard anything from them. I called Friday but couldn’t get through. (Went through all the prompts and got the automated “there’s no one available to help you - try calling later.” 😑

So now I’m wondering when I should expect to hear from DOL again? I’m anticipating a denial and appeal. Anyone with any experience with this I’d appreciate your 2 cents very much. Thank you

Benefits stopped for some reason

I left my job in may because i am a college student that was dorming out of state. they send me the information to apply for unemployment put so i did just that. I went through a long process and they kept sending me monetary determination letters stating that i do NOT qualify for unemployment ( still continued to claim benefits even when i was denied) , but then a week later i get an email and a text saying my claims can be paid and was getting $130 each week . then i get another paper with them telling me i was supposed to be receiving $145 every week which was very weird. two weeks after i received my benefits i went to certify again that sunday and they told me i had to redo my entire claim ( information and all ) and stopped my benefits for some reason, and today i got a monetary benefit letter again saying i don’t qualify for benefits. i’ve been calling the line every single day but i can’t speak to a representative at all to know why this is happening to me. did anyone else have this problem or know why they did this ? and do y’all think it’s likely that i will still receive benefits?

Collecting unemployment - started new business that isn't break-even yet

Got laid off in my 50's after a year of job searching . To cut costs, I left NYC to job-search remotely. It took a while to get unemployment because I had a severance package, but finally got approved in the system. I became concerned that I had aged out of my industry (marketing) so I took out 5 credit cards and opened a small cafe. It's not breaking even yet, but it's showing potential. My unemployment payments are still my only income since any business income is going to payroll and business expenses. I've contiunued to file the way I did when I was actively looking, but that's going to get me in trouble if I get audited and can't prove I'm applying to jobs. Should I just be honest on my weekly applications that I am working now but have 0 income? Has anyone else been in that situation?

I am beyond frustrated

I work in a school (outside company, same schedule) and we get the summer off. I got unemployment benifits last year and it kicked it pretty quick. This year I've been waiting 6 weeks now for it the start. I got a letter with my rate and stating I qualified. I keep calling with no luck and my online messages go unanswered. I don't know what to do. At this point I'll be back to work.

Backpayment owed to me

I filed for UE then got a message that I need to contact UE so they could confirm some info. It took me two weeks to reach them. Then they set the start date incorrectly bc the system wouldn’t allow them to backdate it to the first Sunday after my last day at work. They sent me a form to fill out and I sent it back. Now I’m waiting waiting waiting to hear what happens next - nothing, crickets. Does anyone have a similar experience and if so how long did it take in the end? I feel like this could take months to get the two weeks of pay sent to me. If someone here works for UE, please help!!!

Was approved / Certifying for weeks and then received this call?

This morning I received a call from (518) 704-2704 identifying herself as Patricia from NY state DOL. the voicemail says : “In regards to your application at the department of labor, please call me back as soon as possible at 833-893-0630 extension 8325. You will have 48 hours to call me back that will end by Friday, August 14th before 930 AM. If we do not receive a call from you by that day and time, we're going to make a determination with the information we have on file.“

I was approved mid June for unemployment and have been receiving benefits and certifying weekly since then. So now I’m anxious because I don’t know what this call is about. I don’t have any messages or pending forms on my portal. I tried to call back and left a voicemail for her.

Any ideas what this is? I’m really stressed now

Waiting for claim to be approved

Has anyone had a hard time getting claims approved, and getting someone on the phone? Every time I call I can’t get a live agent. My seasonal employer got a notice on July 10th and approved it, but I still haven’t received any benefits and it’s been about two months since I’ve filed. Thoughts?
