I am a 37-year-old male from delhi NCR. My marriage lasted only 8 months. There are no children from the marriage. We got separated due to countless quarrels and her abusive toxic narcissistic behaviour was unbearable to me.

After separation, she sent her relatives to me for a mutual divorce asking for a hefty amount and they said that they will file cases if I don't comply. I disagreed and then she made multiple complaints before authorities (CAW Cell & Mahila aayog). However, no FIR was registered despite her allegations as police figured out that she is making up stuff. The matter was eventually referred to court, and now a Domestic Violence case has been filed against me seeking extremely high maintenance, compensation, and other reliefs.

What has been particularly distressing is that the allegations are extremely serious, nasty and sexual in nature. The petition portrays me as having committed acts amounting to marital rape, sexual abuse, physical abuse, and dowry-related cruelty. I am in utter shock and I completely deny all of these allegations and maintain that they are false and fabricated.

To the best of my knowledge, no medical evidence of physical injuries or abuse was produced before the authorities. The primary medical documents being relied upon appear to be records relating to urinary tract infections and similar complaints, which I do not believe establish the allegations being made.

Some relevant facts:

At the time of marriage, I was employed with a six figure salary per month.

​

I resigned from my job prior to separation due to performance issues due to harassment by her.

​

I remained unemployed for a significant period after that.

​

I later joined a new job at a much lower salary (around ₹20,000 per month).

​

My wife is a qualified dentist with several years of professional practice and operates her own clinics. Although this is obvious that she will lie on her income affidavit and as she used to evade tax and was inclined on cash transactions.

There are no dependent children involved.

My questions are:

In cases involving such serious allegations but no FIR, how do courts generally view and assess the evidence at the DV stage?

​

How do courts generally assess interim maintenance where the husband's past income was significantly higher than his current income?

​

Out of her 90 something allegations 80 are very nasty and purely sexual in nature like she is someone who might be obsessed with sex

​

What documents should I start collecting now to strengthen my defense regarding both the allegations and my financial position?. Although i have enough proofs which can prove her as extremely abusive during the marriage.

Is it generally advisable to remain defensive and contest the case, or are there proactive legal remedies that respondents commonly pursue when they believe the allegations are false?

- my counsel has advised me only to defend and be prepared for interim and focus on myself. We will eventually file counter cases with full force and won't settle; when the court will drop the allegations after them being proven false (as we will give a tough fight) But obviously this would take time.

​

I understand that every case depends on its facts and I am not seeking formal legal representation here. I would appreciate any guidance from lawyers or people who have handled similar DV proceedings. This could be a great help. Would be grateful 🙏
