Has anyone filed lawsuit for phase 3 ? (IEEPA refund)

I am just curious if anyone has started to file even though there is an uncertainty.

My company has been holding off the filing.

Any clarification for phase III so far ?

So far i heard importers might need to file lawsuit for phase 3.

I was actually waiting for the updated news last week but so far I couldn’t have found out.

Does anyone know if we have any update? Or we still don’t know yet because nobody has clarified

I think we are having a lot of uncertainties now.

It is crazy that importers paid the tariffs which are illegal and they have to file lawsuit to get IEEPA refunds.

It sounds nonsense to me.

All importers in USA might be pissed off for this if it happens

Safe to park at Cooksville Go parking lot ?

I am wondering if it is safe to park my car at Cooksville Go parking lot everyday Mon to Fri

Or not recommended due to car thefts.

If i park there, the car might stay there for 8-10 hrs (park there and take train to downtown for commuting)

For new 301, COO Taiwan/EU

If Country of origin is EU/Taiwan, would it be correct that the additional 10 % is combining rate of the base rate and new 301 tariff ?

For example, if the base rate is 5% , the additional 301 tariff is 5% (total 10%)

But if the base tariff is equal to / more than 10%, then there would be no additional 301 tariff ?

Not sure if my above understanding is correct

If someone could clarify, it would be very much appreciated

Phase 3 and filing lawsuit

So it looks like importers now need to file lawsuit for getting IEEPA refund in phase 3.

I have a few questions.

Should i still file protest with my customs broker ?

It seems to be filing protest might be no longer needed but only filing lawsuit. I heard this from somewhere but not sure if this is true.

Also, My estimated refund amounts would be around 40k. Do you think it make a sense to file lawsuit when we consider the legal cost ?

For phase iii, need to file refund suits at CIT !?

Today i heard from somewhere that filing protest for IEEPA entries might not be sufficient for getting refund in phase iii but we might need to also file refund suits at CIT.

Do you think this would be true ?

For our company, we only have 40K refund for phase 3 (17 entries)

By considering the filing suits fee and potential litigation fee, it may not be worth it ??

at this moment, nobody is sure about phase 2 launch date.

Should we file protests for IEEPA entry liquidation now ?

for our company, the major liquidation will start from July 2026 for IEEPA.

Also, do you think it is required to file a lawsuit in the Court of International Trade (CIT) ?

however, I believe filing a lawsuit would be very costly , not like filing the protest IEEPA entries

new customs broker POA set up

Hi,

I am an importer in USA and in a process of signing a POA for a new customs broker.

They asked me to provide my passport / driver license copy.

Would this be common ? or could this be some kind of scam ?

I have only dealt with the customs broker that our company initially set up and this would be the first time to work with the new customs broker.

I am confused why they need my passport/driver license copy.

For those who received IEEPA refunds

I am an importer in USA and just curious.

As subject, Have you received the refunds to your bank account or your customs broker received the refunds ?

I have seen some posts that even though the importer setup for ACH, the refunds still go to the customs broker side.

Will the customs broker probably charge us some fee for the transfer of the funds ?

How do we know if PSC gets completed ?

I have 1 customs entry which we did the PSC last year.

Now i see the refund issued in rev 603 report for this entry.

Can i assume all the PSC process got completed now for this entry and it is good to submit CAPE now ?

Also, if CAPE rejects this entry for some reason, i guess i can fix the issue and resubmit it , right ? The rejection might not mean the permanent rejection and we lose the eligibility for getting the refund forever ?

Consolidated refund ID in REV-615 (CAPE)

For Consolidated refund ID in REV-615 (CAPE),

Should we put our pay ID (importer number) or claim number in CAPE ?

Both didnt work. The report has not shown anything for 3 weeks

Or sth else we need to put in ?

How do you set entry summary date ?

Should i set it as 1/1/2025 ~ today’s date ?

Do you set any filter other than entry summary date ?

Because when i run es003, i dont see all entries there.

For example, i submitted 110 entries but i only see 51 entries in es003.

Not sure why, so far i haven’t seen any rejection in rev615 report.

I dont know if this is simply because CBP is still processing the refund. I filed on 5/4/2026

Hi,

I heard that now filing CAPE & Protest at the same time are impossible. We need to file either one of them.

Final liquidation date would be Oct 2026.

Now our company has to file the protest for the auto part tariff and fight back.

We believe our commodity is not subject to auto part tariff but CBP recently sent us CF29 and explained we need to pay auto part tariff 25 %.

And these entries are eligible for IEEPA refunds.

Scenario 1.

We file the auto part protest firstly and then file CAPE in phase 2.

Risk : we don't know when we are going to have phase 2. We have risks that the entries get all finally liquidated before phase 2 comes.

=> Then we will lose the opportunity to get IEEPA refunds.

Scenario 2.

We file CAPE firstly and as soon as the refund gets received, we file the auto part tariff protest.

Risk : I don't even know if we can file CAPE now since CBP recently touched the entries by issuing CF29 and quick liquidation for the auto part tariff adjustment.

Even if we can file CAPE, if the refund cannot be finalized by Oct 2026, we lose the opportunity to protest for the auto part tariff.

=> This will potentially impact our business in a negative way

I believe our company has more risk on Scenario 2 so I might go with Scenario 1 but what would you do if you were me ?

First time i thought my neighbour swapped unintentionally.

I checked the security camera and found out the this garbage man swapped it with my neighbour’s when he put it back.

So annoying.

I guess my neighbour did not notice but i noticed because his trash bin is cracked. Mine is not.

Now i am having his cracked trash bin 😂.

Should i tell him that the bin got swapped or let it go ?

What would you do ?

maybe i misinterpreted the thing but according to https://www.cbp.gov/trade/programs-administration/trade-remedies/ieepa-duty-refunds ,

they will include "entries for which liquidation is final (last row)" in upcoming phases.

I guess the court/CBP might be planning to refund everything including the finally liquidated entries.

We still don't know yet but at least this is something positive in the meantime.
