I am seeking legal advice regarding a UPI transaction dispute that has remained unresolved.
I found a seller on OLX who dealt in electronics and mobile accessories. Before the disputed transaction, I had successfully purchased a headphone from him. Since the first transaction went smoothly, I trusted him and decided to buy from him again.
On 17-Apr-2026, I made a UPI payment of approximately ₹3,000 for another purchase. Initially, I tried sending the payment to the UPI ID that I had used during the first transaction, but the payment failed. The seller then asked me to send the money to a different UPI ID.
One detail that concerns me is that the name displayed on the first UPI ID was different from the name displayed on the second UPI ID. However, since I had already completed a successful purchase with the seller in the past, I did not think much of it and proceeded with the payment as instructed.
The second payment was successful, and the amount was debited from my SBI account. Shortly afterward, the seller informed me that he had not received the money.
To resolve the issue, I visited my SBI branch, but my complaint was not accepted. I then contacted SBI Customer Care and was advised to register the matter as a "wrong account transfer" complaint. SBI subsequently raised a chargeback/recovery request with the beneficiary bank, Kotak Mahindra Bank.
After the waiting period, SBI informed me that Kotak Mahindra Bank was unable to recover the funds because they could not contact the beneficiary account holder. SBI advised me to contact Kotak Mahindra Bank directly.
What concerns me further is that the seller has now become completely unreachable. His mobile number has been switched off for more than a month, and he has not responded to any calls or messages. This has made me question whether he genuinely did not receive the payment or whether he received the money and later disappeared.
I have the following evidence:
UPI Transaction ID (UTR),
SBI complaint/reference number,
SBI's written response regarding the failed recovery attempt,
Screenshots of chats with the seller, Seller's phone number,
UPI/payment details.
My questions are:
Does this appear to be a case of cheating or online fraud?
Should I file a complaint through the Cyber Crime Portal?
Is there any legal remedy available to recover the money?
Is SBI's responsibility considered fulfilled once the chargeback request has been raised?
Can SBI or Kotak Mahindra Bank be required to investigate further?
What would be the most practical next step in this situation?
