Ontario – Trespass Notice After Delivery App Payment Failure and Store Escalation

I’m seeking legal information regarding an incident in Ontario involving my work as a delivery driver for a third-party gig platform.

While completing a grocery delivery order at a large retail grocery store, one of the orders in my batch was declined due to a platform-side payment issue. I did not use any personal funds and was not in possession of any unpaid goods for personal consumption. I remained at checkout and immediately contacted platform support to resolve the issue.

I waited approximately 30 minutes for platform support while remaining present and attempting to comply with store expectations. I communicated to staff that I was actively resolving a payment failure through the platform and was awaiting instructions.

Despite this, loss prevention staff approached the situation as suspected theft and escalated it without resolution of the underlying payment issue. The situation ultimately escalated to police attendance, and I was issued a trespass notice from the premises.

I am trying to understand the legal framework governing situations like this, particularly in Ontario, including:

  • Whether store loss prevention actions in situations involving third-party payment failures are expected to follow any standard of procedural fairness or reasonableness before escalation
  • Whether issuing a trespass notice in circumstances involving an unresolved platform payment error could be subject to review or challenge
  • What legal remedies exist where a misunderstanding results in removal from a private commercial premises and police involvement
  • Whether there are any applicable Charter-related considerations (e.g., arbitrary or biased enforcement in practice, or state involvement once police are called), even where the underlying issue begins as a private dispute
  • What oversight mechanisms (if any) exist for reviewing loss prevention conduct when it results in police escalation

I have already submitted a complaint to the platform and intend to submit a formal complaint to the retailer requesting an internal review of the incident and staff response.

I was trespassed from Superstore while doing an Instacart order

I'm still trying to process what happened today.

I was shopping an Instacart batch at Superstore on Yonge Street in Newmarket, Ontario. When I got to checkout, one of the orders in the batch kept getting declined. It wasn't my personal card—it was the Instacart payment, and there was nothing I could do to fix it myself.

I immediately contacted Instacart Support and ended up waiting around 30 minutes for an agent to help me. During that entire time, I stayed at the checkout, explained that I was waiting for Instacart Support, and wasn't trying to leave with any merchandise.

Instead of trying to understand the situation, Loss Prevention approached me and treated me like I was trying to steal. I repeatedly explained that I was an Instacart shopper waiting for support because the payment was failing, but it didn't seem to matter.

The situation escalated to the point where they called the police, and I was issued a trespass notice from the store.

What made this even worse is that I genuinely felt like I was racially profiled. I can't prove what was going through anyone's mind, but based on the way I was treated compared to simply being a shopper waiting for a payment issue to be resolved, that's how the experience felt to me. It was humiliating, embarrassing, and completely unnecessary.

The most frustrating part is that this all could have been avoided if Instacart Support had responded in a reasonable amount of time. Instead, I was left standing there with no help while the situation spiraled out of control.

I've already filed a formal complaint with Instacart and intend to file a complaint with Superstore as well. I'm asking both companies to investigate what happened, review the actions of the Loss Prevention staff, and explain why this situation was handled the way it was.

Has anyone else had an Instacart payment decline like this? If you've ever dealt with Loss Prevention while working as an Instacart shopper, how did you handle it?

I'm also interested in hearing whether anyone has successfully appealed a store trespass or pursued a complaint after feeling they were treated unfairly.

This was honestly one of the most degrading experiences I've had while simply trying to do my job.
