Landlord verbally abused and threatened me in front of my guests, texted me to vacate, and now wants to deduct ₹14,000 from my ₹40,000 deposit. Need advice.
Hey everyone, long post but really need some guidance here. This has been building up for a while and today it escalated badly.
Background:
I moved into my current rental in Bengaluru about 9 months ago. Paid ₹40,000 as security deposit. Monthly rent is ₹14,000. The agreement has a clause saying they'll deduct 1 month's rent (₹14,000) when I vacate.
For the past few months, my landlord has been progressively getting worse talking rudely, unnecessary complaints, making things difficult for no real reason. I had already started looking for a new place because of this behaviour.
Today it got really bad:
My guests were over and my landlord came and started shouting and continuously verbally abusing me right in front of everyone. It was humiliating. They also threatened me saying "if you don't come down, something bad will happen."This was heard by my guests who were present.
And then they actually texted me to vacate the premises. I have that text saved.
My questions:
- Since THEY texted me to vacate, can they still legally deduct ₹14,000 from my deposit? I feel like I'm not voluntarily leaving — they're forcing me out
- Is the threat ("something bad will happen") something I can use legally if needed?
- I've already drafted a legal notice demanding the full ₹40,000 back. Is that the right first step?
- I want to resolve this peacefully if possible. What's the most effective way to do that without going to court?
What I have as evidence:
\- The text message asking me to vacate (saved + screenshot)
\- Multiple witnesses (my guests) who heard the threat and saw the abuse
\- 9 months of on-time rent payments
I'm not looking to create unnecessary trouble. I just want my full deposit back and to move out peacefully. Any advice from people who've dealt with similar situations in Bengaluru or Karnataka would be really helpful.
