In short, the appeals waiver that Bryan Kohberger (and every defendant who pleads guilty) had to sign **will no longer be enforceable** *if* it would result in a miscarriage of justice.
Famous miscarriage of justice cases are the West Memphis 3, the Central Park 5, and Amanda Knox, just to name a few.
A miscarriage of justice usually involves wrongful convictions, coerced confessions, eyewitness misidentification, or flawed/exaggerated forensic evidence (sound familiar?). That’s just a few examples.
This is entirely separate from the post conviction relief options available. And according to google, all appeals must be exhausted before post conviction relief can be pursued.
Can we be expecting an APPEAL from Bryan Kohberger soon? Only time will tell. 🤞🏼
