Pre debt court hearing proceedings for FPN
Hi everyone,
I’m looking for some advice regarding a £600 fly-tipping Fixed Penalty Notice from Ealing Council.
I live above commercial premises and there are no communal bins for residents. My letting agent told us that residents leave their household rubbish at a particular location for collection.
The rubbish involved was ordinary household waste, but I put it out on a non-collection day.
I received the FPN in May and submitted a written explanation stating:
I live above businesses with no communal bins.
My letting agent advised that this was the correct place to leave rubbish.
The waste was normal household rubbish and not dumped illegally.
I received an acknowledgment email informing that that my representations would be reviewed and that I would receive a response. However, I never received any decision or acknowledgment of my explanation.
I have now received a “Pre-Court Proceedings” letter stating that the matter may be referred to the Magistrates’ Court if I do not pay the £600.
Has anyone experienced something similar with Ealing Council or another council? Should I ask for the evidence and confirmation that my representations were considered? Is it normal for a case to proceed without responding to the explanation that was submitted?
Any advice would be appreciated.
