Questions about concerns of 2-day CPET from an LTD Lawyer (USA)

Hello! My name is Andrew and I'm a disability lawyer. I'm doing a webinar in a few weeks about disability benefits with Staci Stevens from Workwell, who plans to discuss the 2-day CPET.

I have recently seen a few references in this community to concerns about the 2-day CPET. Would anybody here be willing to share those concerns with me, so I can better understand them and help support my clients? I hope to also explore and address those concerns during the webinar.

And the free advice I'll give in advance to anybody worried about undergoing a 2-day CPET, or if you aren't located in NY or CA - a strong neuropsych report combined with a statement from your physician that the 2-day CPET could be detrimental to your health can be an effective alternative. Just make sure to undergo a neuropsych with someone who understands fatigue-related illnesses so they don't mistake your fatigue for a lack of effort.

Even more exciting (in my humble opinion) is that Staci and I will be hosting an AMA on this subreddit in July! We are still nailing down the exact date, but I am already looking forward to it. My colleague Megan who handles SSDI and I just did an AMA on r/disability and I really enjoyed it.

Hello everyone, and welcome to our AMA!

My name is Andrew Kantor. I work primarily on private disability insurance claims (short-term and long-term disability) through employers or individual policies), and I’m here with my colleague Megan DiTolla (u/MFD2026), who focuses on SSDI.

We know a lot of people here are dealing with denials, delays, or just trying to understand how the system actually works - especially while managing health issues. A lot of the situations we see in our work are the same ones that come up in this sub.

We're happy to answer questions about things like:

  • SSDI
  • Long-term and short-term disability insurance ("STD" & "LTD")
  • Denials, appeals, and delays
  • Medical evidence and documentation
  • How insurers and the SSA evaluate claims

We’ll do our best to explain how these systems tend to work behind the scenes and where people often run into problems.

We’re starting today (April 28) at 12 pm PDT and will keep this open for at least a week, so feel free to jump in whenever you're able.

We can't give advice on specific situations, but we're happy to share general information and point you in the right direction.
