My wife is being held and beaten by her own family for marrying me, need real advice, not sympathy
Long post, but I need people who actually understand the legal side of this in Pakistan, not just opinions.
Some context first: I was already married when I met her. I told her this from day one — I never hid it. She accepted it fully, with open eyes, and her feelings didn't change. This is a second marriage, done with everyone's knowledge on my side and, eventually, with her own repeated consent stated in front of her family.
How we got here:
- Her father found out we were in contact early on and confronted both families. He asked her directly, in front of everyone, if she wanted to marry a man who was already married. She said yes — five times, not once.
- Her maternal uncle got involved, things got hostile, but my family left peacefully rather than escalate.
- I went to her house with a formal rishta, respectfully, with my full family. We were humiliated, and that same day her parents beat her with a wooden rod for refusing to back down.
- She kept getting caught with phones we used to stay in touch, and each time led to worse beatings — at one point she was, in her own words, beaten nearly to death.
- We did our nikkah quietly while she was away for exams, fully consensual, fully Islamic, no coercion on my end at all.
- Her family found out again, beat her again — father, mother, and sister this time — and eventually filed a police case, which turned into a Habeas Corpus hearing.
- At that hearing, she said she wanted to stay with her father. I later found out this was because her family had explicitly threatened to kill me and my entire family if she said anything else. That statement in court was not a free choice.
- After the case, a relative of hers, someone with real influence/connections who has directly threatened to kill me and my family, made a demand: register a 3-marla house property in her name and she'd be allowed to leave, through her, I have voice recording of the call, where she is being told in the back. I've been working on meeting this, in good faith, while trying to figure out the legal side too.
- Her phone has now been confiscated entirely. She's been told if she ever tries to leave with me, she and my whole family will be killed. Her only way of reaching me is a secret email account, and she's using it at real risk to herself.
What I actually need help with:
Can a Habeas Corpus statement be legally challenged later if it can be shown it was made under a death threat?
What's the real process for getting FIRs registered for repeated physical assault when the victim is still trapped in the house with her abusers?
Is the property demand legally extortion, and is there a way to report that without making her situation more dangerous?
Are Violence Against Women Centres (VAWC) or District Women Protection Officers actually effective for something like this, or is that mostly on paper?
How do people in similar situations get a welfare check done discreetly, without tipping off the family and putting the person at more risk?
She is my wife under Islamic law, by her own repeated choice, and she is currently being held and hurt for it. I'm trying to do this the legal way instead of doing something reckless. Any real experience, lawyer recommendations, or knowledge of how these cases actually play out in Pakistani courts would help a lot.
If I register this complaint over CM Complaint Cell would it help?
I am not scared for myself but for everyone else around me, for me if death is in this way, I am happy to accept it.
