Tesla rental coverage over 30 days due to their delays?
Hello - I was involved in an accident on 5/6/26 (not at fault) and initially decided to go through the other party's insurance (AAA) to repair my vehicle (2022 Tesla Model 3). I'm in California, if that makes a difference.
5/29: Dropped off vehicle at the Tesla Collision Center for teardown/estimates. Also picked up my first rental vehicle direct from Tesla.
6/8: Received the repair estimate of $17.5k. I conveyed this to AAA and was told this was over the third party's policy limits of $15k. At this point, I decided to go through my insurance (Tesla) for repairs.
6/11: Tesla Collision provided Tesla Insurance with an updated repair estimate ($13k).
6/12: Returned Tesla rental since I was leaving for a vacation.
6/24: Returned from my vacation and picked up another rental from Enterprise.
6/29: I found out (after nonstop calling bc no updates in 2 weeks) that this was denied and another estimate (without the Tesla discount) was submitted on 6/19, which I believe is currently under review.
6/30: They told me my vehicle was under potential total loss review.
7/6: Followed up with my adjuster and she has no additional updates. My rental coverage will end on 7/8 and she said she can extend it to 7/10 because the daily rate for my current vehicle is under the $45/day so I have a little buffer.
I'm honestly at a loss on what to do at this point. They won't give me a clear decision on whether they plan to repair or total my car and I'm running up on my rental coverage. One insurance agent I spoke with at Tesla said there are no exceptions to the rental coverage and then another was very apologetic and said they sometimes make exceptions if Tesla is causing the delays--which is my situation here. Tesla Collision and Tesla Insurance are not able to come to a consensus, and I'm stuck in the middle without my vehicle.
Is there any way legally I can get Tesla to cover a rental until I either get my vehicle back or they make a determination on totaling my car? Or anyway I can get the third party's insurance to cover it? Complain to CA Dept of Insurance? Tesla Insurance has been a real PITA to get a hold of and I'm so frustrated by this whole situation, especially since I'm not at fault for this accident. The Tesla Collision Center guy has been great in keeping in the loop--basically to say that there are no updates, so I don't fault him here.
