Running out of patience

I485 expected approval , Eb2 India (PD not Current), I485J approved

Hello,

Need some insights on my situation.

My RD is April 15, 2026 and PD is Dec 9, 2014 EB2 India(so not current yet). If the PD becomes current In Oct 2026 bulletin, what is the expected timeline to get I485 approval? I485J has been approved and case status has changed to active review where it remains.

If PD becomes current in October 2026 bulletin, can I expect I485 approval in October 2026?

I wanted to share my EB-2 NIW timeline in case if it helps anyone.

My background:

  • PhD Student in Civil Engineering at State School
  • U.S Masters Degree in Civil Engineering (Water Resources Engineering)
  • 9 publications and 77 citations at the time of filing.
  • Texas Service Center
  • Attorney: Chen Immigration Law Associates
  • Proposed PE included: Wildfire-Watershed, Flood, Groundwater, Compound Hazard

Timeline:

  1. USCIS received petition: April 21, 2026
  2. Upgraded to PP: May 8, 2026
  3. i 140 approved: June 30, 2026

Experience with Chen:

Overall very positive experience. They drafted most of the things themselves. We had some back and forth at the PE initially about the impact of my work (They are related to hydrology, wildfire-watershed, groundwater, and compound hazards). I am kind of open source researcher and I wanted to put that into PE and Chen did excellent job on going through github repos and putting the necessary stuffs in the PE. Apart from that, they prepared the PE as per the information I provided. Some people have said the petition was too generic but I didn't find that in my case. I say they understood my background, publications and goals pretty much well. They respected the initial timeline they offered meaning the response was great and the preparation time was as per they said initially. It was a good experience working with known legal team after all.

Also, I would like to thank this reddit community as well. Reading other timelines and experiences helped me a lot through out the process. Hope this also helps someone else who is waiting for their case.

Suggestions to all:

  1. I think real impact should reflect on the PE on the most common words with some technical hint (Chen did a very good job on that I would say)
  2. Be patient during preparation. Don't try to be fast during the preparation. Take your time. It is a lot of money that you are putting into.
  3. Update CV, citations regularly as it matters.

Hello there! I wanted to share my timeline with you. My GC got approved finally! I'm praying whoever is waiting their GCs and reads this will have his/her GC approved soon.

PERM Approval: 01/26/2026

i140 Filing: 03/26/2026 (Regular Processing)

Concurrent Filing of i485, i765 and i131: 03/26/2026

i140 Approval: 04/01/2026

Biometric: 04/09/2026 (Walked-in)

Silent Update: 04/10/2026

i485 Approval: 07/01/2026

My status never changed from "USCIS is currently processing..." until the case is approved.

i765 and i131: Currently in process (Lawyer said I can ignore this now since i485 approval supersedes these two).

Single Filer. No dependents.

FO was in Texas. Not transferred.

3rd FTA0 (I485) about 20 days ago, no update since then. What does it mean?

Hi everyone,

My RD is October 2025. My case was moved from NBC to the St. Paul Field Office on June 2. Then I had a third FTA0 around June 15, but there has been no update since then.

Does this usually mean the officer is still working on the case, or could it indicate that more background checks are still pending?

I know every case is different, but I wanted to see if anyone had a similar experience after multiple FTAO updates and how long it took to get the next update or decision.

Question about biometrics and EAD/AP filing order

My spouse and I just completed our biometrics today for EB2 485s that were received on 05/15. I also received 2 FTA0 updates along with a silent touch.

However, we plan to file EAD/AP in the coming week ( as the company policy was to strictly not file EAD/AP concurrently). When I asked my attorney, they mentioned we will be called for biometrics again but I’m just curious what purpose did today’s biometrics serve if they are going to call me back in 3 weeks? Is my attorney correct here?

Hey everyone, looking for data points.

Background:
EB-2 PERM ROW derivative spouse interview - beginning of June
Interview went smoothly standard questions only
Primary and child approved a few months ago

Post-interview API signals:
FTA1 appeared same day
actionRequired changed to false same day
No movement since other 15 days of silence

Agents say: “Continue Decision — further review needed” and “doing fine, keep waiting”

Questions:

**1.**	Is silence after clean interview normal?  
**2.**	How long did your H008 take to appear after interview?

Any updates for folks at the Santa Ana FO?

I have an EB3 485 stuck at the Santa Ana FO (non-local for me) since early Feb 2026.

Last API updates were in mid-to-late April 2026. PD's been current since Feb, original 485+485J+131+765+693 were filed in late Oct. 2025.

I was wondering if there are others (EB 1/2/3) stuck at or if others have seen updates at Santa Ana FO..??

RFE the officer didn't read my petition

Any advice from your experiences could help

So basically got an RFE after 43 business days on all 3 prongs

The RFE was very rough not because it wanted specific things but was talking about things that I never mentioned in my petition/ proposed endeavor neither in exhibits

Basically I'm a postdoc in university and all my researches are based on the transmission of the disease called schistosomiasis that is basically hosted by freshwater snails I study the genomic part of the snails and this research would give a better understanding for other infectious diseases transmission

Anyway the most dramatic part was the letter it literally addressed things that I never mentioned in my PE saying that I'm working in healthcare and benefits for healthcare and it questioned whether it's going to be impactful for larger part of the community other than my clientele??! I never mentioned healthcare or clients I literally work in research

It also said that I was talking about improving healthcare cost and advancing economic growth it has nothing to do with my petition

I submitted 6 LOR 3 of them were independent from senior leaders in the field and they literally said that we know each other??!! There were a name in the end of the letter ~Carrie M selby ~

When I looked it up lots of ppl seemed to be having the same problem a vague RFE followed by denial

Now i'm really discouraged did you have any experience with an officer like that any help is welcomed

PERM denied due to remote/travel issue. Employer refiling. Should I pursue NIW or EB-1A independently?

Hi everyone,

I’m looking for advice from anyone who has been in a similar situation or has experience with employment-based immigration.

Here’s my situation:

Currently on H-1B ending November 2026
Working as a Validation Engineer at XXXX in the medical device industry(Full Time).
I hold three master’s degrees and an ASQ Certified Software Quality Engineer (CSQE) certification.
My work involves FDA-regulated medical device software validation, quality systems, compliance, and computer system validation.
My employer filed my PERM in June 2025. Unfortunately, it was recently denied. According to our immigration attorney, the denial is related to the Department of Labor’s current position on employees who work remotely and/or travel as part of their job. They mentioned that many PERMs have recently been denied for the same reason.

The plan from my employer is:
File a Motion to Reconsider within 30 days.
Once the motion is pending, file a 1-year H-1B extension using premium processing.
Start a brand-new PERM process immediately.
File the new PERM before my H-1B expires in November 2027.

I asked about alternative options like O-1, EB-1, and NIW. The company attorney responded that Advanced Bionics will not pursue those options but that I am free to pursue a self-sponsored EB-1A or NIW if I choose. They also cautioned that denial rates have increased under the current administration.
I’m trying to decide whether it’s worth pursuing an NIW or EB-1A independently while my employer continues with the PERM process.

My questions are:
Has anyone had a PERM denied for the remote work/travel issue and then succeeded after refiling?
Based on my background, does an NIW seem worth exploring, or would it likely be a difficult case?
Is EB-1A realistic, or is that probably a stretch without publications, patents, or national recognition?
Can an NIW and an employer-sponsored PERM proceed in parallel without causing issues?
Can anyone recommend attorneys who specialize in strong NIW or EB-1A cases for engineers in regulated industries rather than researchers?

I’d appreciate any experiences or advice from people who have gone through something similar. Thanks in advance!
