Kleinigkeiten in der Klausur

Ich wollte mal fragen, ob ihr ein paar Tipps habt, wie man sich in einer Klausur durch Kleinigkeiten abheben kann. Klar, ich weiß schon, dass eine Klausur nicht von Kleinigkeiten abhängt. Es kommt vor allem auf das Gesamte Gutachten an, also auf das Wissen und die Subsumtion. Auch gibt eine schöne Formulierung nicht sofort einen Punkt mehr.

Es wirkt sich trotzdem nach meiner Erfahrung auf den Gesamt Eindruck aus und man kann sich trotzdem durch Kleinigkeiten positiv abheben. Habt ihr vielleicht Dinge, die ihr ständig macht und die sich total positiv abheben? Oder Dinge, die die meisten Leute vergessen und die sich deshalb positiv auswirken.

Bei mir:

- Immer Kontrollieren, ob ich beim AG bin und deshalb die Verweisnorm in die Vorschriften des LG brauche

- Strafrecht Konkurrenzen definieren. Ich habe zwar immer noch keine Ahnung, wie ich sie bilde, aber die Definitionen werden positiv Bewertet und es sieht zumindest optisch nach mehr aus.

Manifestation group like old friends

Good morning – would anyone be interested in a manifestation group for mutual scripting?

I’ve been thinking it would be lovely to have a group where, just like old friends, we could chat about what we’re doing right now – but in our ideal lives – as often as we like, whether that’s several times a day or less, whatever suits us

We can share our day as if our wish had been fulfilled and get a feeling of what our ideal life would be like.

Like old friends, we can ask each other follow up questions about what we wrote – for example, One of us ist manifesting a big vacation and is telling how the day went and than one is asking What was the weather like, what are you planing for tomorrow,’ – and tell each other about ourselves. The lovely thing is that neither of us knows what has already happened or what is an ongoing manifestation. But even so, when you’re writing, you get that feeling of a wish being fulfilled. I think it’s a lovely exercise.

Schadensersatz Verzweiflung

Verzweiflung. Ich sitze schon den ganzen Vormittag an diesem Problem und glaube, dass ich auf dem Schlauch stehe. Ich habe es jetzt schon mehrmals an verschiedenen Tagen probiert und weiß mir langsam nicht mehr zu helfen. Kurz vor dem Examen habe ich mittlerweile hundert Sonderprobleme gelesen, aber anscheinend scheitere ich am Stoff des zweiten Semesters. Vielleicht kann mir das ja jemand in einfachen Sätzen erklären. Das Thema ist Schadensersatz statt und neben der Leistung. Es gibt die phänomenologische und die zeitlich-dynamische Abgrenzungsmethode. In der Regel kommen beide Ansichten zum gleichen Ergebnis, mit Ausnahme des verfrühten Deckungsgeschäfts und des Nutzungsausfalls aufgrund von Schlechterfüllung. Da komme ich noch mit.

Aber beim Thema „mangelbedingter Nutzungsausfallsschaden” komme ich einfach nicht weiter. Im Rahmen der zeitlich-dynamischen Abgrenzungsvariante gibt es den Streit, ob es sich um eine einfache Schlechtleistung oder einen Verzugsschaden handelt. In beiden Fällen handelt es sich um einen Schadensersatz neben der Leistung, lediglich die Art der Pflichtverletzung ist umstritten.

Das leuchtet mir alles ein. Aber zu welchem Ergebnis kommt die phänomenologische Abgrenzung? Ich finde dazu nichts beziehungsweise nur sich widersprechende Sachen. In einer Probeklausur des Reps steht in der Lösung lediglich, dass offensichtlich ist, dass alle Ansichten zum gleichen Ergebnis SE neben der Leistung kommen. Ohne Begründung. In einer Lösung von der Uni steht das Gegenteil. Kann mich vielleicht jemand vom Schlauch runterziehen?

Your own language is much more powerful

I’d like to share an experience and I’d be interested to hear if you have any honest experiences of your own or just your general thoughts on the matter.

Affirmations are a wonderful tool. However, I’ve personally stopped using them in the traditional sense and have moved on to ‘self-talk’. When I first started out, I liked to adopt other people’s affirmations and searched for the ‘perfect affirmation’ as if it were a magic spell.

Money loves me

I radiate positive energy

I release all doubts and replace them with confidence and certainty.

Sounds great, doesn’t it? But let’s be honest – who actually talks like that in everyday life? I certainly don’t. That’s why affirmations have often felt a bit strange to me.

So I started asking myself how I would say that to someone else, and then applied it to myself.

At the same time, I changed the language. Most of the content and Affirmations are in English. I’ve been fluent in English for years; when it comes to films and music, I don’t usually notice any difference. My mother tongue, however, is a different language. I

I then took it a step further: in my mother tongue there are various dialects, and I personally spoke one of them outside university as well. My natural speech is not always grammatically correct and often features the use of colourful proverbs.

So now I have a list of affirmations in my mother tongue, including proverbs and phrases that I use quite naturally. I’ve also included phrases that my family or those closest to me like to use, to create a familiar, homely atmosphere. In particular because our subconscious is heavily shaped by our childhood, and it was during that time that my mother’s choice of words had an influence on me. I feel that this helps me a lot. Regardless of the results, it feels more natural and makes me feel more at home when I hear it. I also see results say more faster.

However, I still sometimes find it difficult to formulate them or to rephrase other people’s. Ultimately, though, I still feel that, as with many things, it comes down to going back to basics. Affirmations and manifestation should come naturally, rather than being a chore or a complicated process where you are afraid that it stops working immediately if you make a mistake. Has anyone had similar experiences?

Examensklausur im Europarecht

Guten Morgen,

ich bereite mich gerade auf mein erstes Staatsexamen in Bayern vor. Gestern Abend hatte ich einen Kurs zur Klausurenbesprechung im Fach Europarecht. Die Dozentin hat uns darauf hingewiesen, dass Themen aus dem zweiten Examen oft kurz danach im ersten Staatsexamen drankommen können. Da Europarecht und Staatsrecht schon länger nicht mehr dran waren, seien sie jetzt sehr examensheiß. Lassen wir mal dahin stehen, ob eine solche Bewertung wirklich möglich ist. Deshalb wollte ich fragen, ob jemand die 8. Klausur des letzten Durchgangs mitgeschrieben hat oder sie sonst kennt. Es ging um die Rechtmäßigkeit eines Tabakverbots. Vielleicht kann sich jemand noch daran erinnern, insbesondere an den Punkt mit der Begründung der Nichtvorlageerforderlichkeit und der verwaltungsrechtlichen Einkleidung.

I’ve been exploring the topic of manifestation for quite some time now, have read a number of sources on the subject, and have already had a fair bit of success. Unfortunately, however, I keep coming up against a recurring problem when trying to manifest good grades.

A little background information: I’m studying law and have my finals in September, which are comparable to the American Bar . The results for those will be released in January. So I know for certain that I won’t achieve my goal until then.

That’s why I find it incredibly hard to do my SATS and other exercises, and then get back up and carry on studying and writing practice papers.

I feel as though I can’t manage to live as if it’s already happened, even though I’m doing everything I can to make it happen.

That’s why I’m worried that it’s more a case of daydreaming and thinking about the future.

The only time my manifestation ‘didn’t work out’ was with a final dissertation. I felt exactly the same way then. In the end, my result was still good, which I think is down to the fact that I have strong inner confidence when it comes to my skills

However, I don’t want to rely on that alone, because anyone familiar with law knows how quickly and severely this inner confidence can be undermined by other professors and others.I have already made a conscious effort to distance myself from all such negative influences as much as possible.

Has anyone had similar experiences with manifestations on a specific date, and do you perhaps have any tipps? I feel having a direct date in the future is against all learnings
