[Landlord US-NY] Tell me how can I get earlier court date?

I have a house in Brooklyn New York.

I have a tenant who hasn't paid rent in last 8 months, and I have started the process already with a lawyer. I just got a court date just now of December???? He moved in 9 months ago.

My lawyer filed a case against him for non payment and he had to answer within 10 day by august, and tenant just replied and chose "Other: need time to pay".

NOW the court date has been set for December. Please tell me if there is a way to get earlier court date. He has already lived here for 8 months without rent, he can't just live here for next 4-5 months too? He is also bothering the neighbors too and spreading trash which I am going and cleaning.

I am paying mortgage and paying utilities too, please tell me if there is away to get earlier date?
I am currently unemployed too. I can't afford him to stay for next 4 months. I don't want to loose my house to bank, while he will just stay there for free and will move to another house do the same thing.

In the petition of notice, it said "When you Answer the Petition, you will get a date to come back to Court 3 to 8 days later" But this is 4 months?

Sorry I am panicking since I am unemployed and have to pay huge mortgage and bought this house thinking I can get an extra income, instead I am loosing money and going in minus and I had to take a loan too earlier this year from someone else.

[landlord US-NYC] tenant is asking for a cleaner?

Water leaked from the ceiling and it made a little bit of a mess in the bathroom. Now the ceiling is fixed, but the tenant is saying to send him a cleaner to get the bathroom cleaned. I asked him can't you just clean it yourself, he replied no he didn't make this mess.

Who is responsible for cleaning?

I have no problem getting it cleaned if I'm responsible.

why does taskrabbit keeps charging me even when tasker cancels the task?

I just don't understand, why they keep doing this. Anytime tasker cancels the tasks or if they aren't able to do the task and they told me before hand, but they still charge me and I have to contact taskrabbit and check my bank account.

I like this app, but I don't like they secretly keep charging my bank account and once I talk to them then they return the money. So if I don't' check my bank account then they won't return my money??

If they do this for 100 people they are getting free money. Seems like scam?

[Landlord US - NYC] Half of the lawyers are saying I can file for nonpayment, while the other half are saying I can't because there is no lease

The house is located in Brooklyn, NY. Half of the lawyers who handle evictions and does the whole process for you that I have spoken with say that I cannot file a nonpayment case and can only file a holdover case because there is no written lease, while the other half say that I can file a nonpayment case.

Although there is no written lease, everything is documented in WhatsApp messages, and he is clearly a tenant. Even now, he continues to say in WhatsApp messages that he will pay the rent, but it has been seven months and he still has not paid. He keeps making excuses.

He moved in last November and only paid rent for the first month.

The reason I want to purse nonpayment one is because I have heard it is faster, and I am trying to get whichever is fastest.

My question is: Does anyone know whether it is possible to file a nonpayment case in this situation?

I'm in NYC. At the start of the month he says he will leave at 15, on 15th he says he will leave at the end of month. Going through the process will take at least a year. He and his wife, both work, but he just doesn't want to pay, since why pay if he can save that money. I think he also rented out extra rooms to someone else too. He paid only first month rent, then haven't paid since then in the last 6 months.

He keeps telling me, he will leave, he is looking for an apartment, it's raining today, etc etc. He even stopped replying to me now. And he just replies at 15th or start of the month to say the same thing.

I have talked with companies who do eviction, they all have told me they can start the process but it will take around 10 months, and even with the eviction I can't get the rent which he hasn't paid or needs to pay. Basically he can stay for a year for free.

I'm paying his utility too since the basement shares the utility. I'm paying a mortgage too, I'm losing so much money while he is earning money from the house which I bought! And in NYC it can go on for a year while he lives rent free and I pay for all his utilities.

Is there any method I can use to just make him leave!?

I'm unemployed too right now!

Tbh I don't know how he sleeps at night, he could care less if I go bankrupt and lose my house, he will just move to the next house and do the same thing there and stay rent free.

I feel so so angry right now at NYC rules!! I worked so hard and gathered down payment for a house over the years, and now because of the eviction process in NYC he can just stay for a year without paying rent while I keep paying mortgage and his utilities!! Recently I also had to get a loan from others too.

About him: I just want him out. I also think maybe he is illegal in USA too. He has children too.

I have thought of calling child protective service too, to just make leave. But I'd feel so bad doing that.

Any advice would be appreciated.
