Jackson's dissent in Wolford is insane

I don't know where to even start with this. Bruen explicitly rejects the "means-end analysis" that Jackson prefers; Jackson responded in Hemani by stating that she would overturn Bruen. The majority in Wolford admonished her yet again that she can't use "means-end analysis" to eliminate the second amendment.

Here are some nuggets from her dissent in Wolford, which attempts to re-frame the case as a property rights case:

>Hawaii’s law does not implicate the Second Amendment because there is no right to carry a gun onto private property without consent (as all agree)

All do not agree on this. The majority opinion and the concurrence from Justice Barrett make it clear that you're the outlier here. The right to bear arms for self-defense is not consistent with a law that criminalizes the bearing of arms in day to day life.

>For what it is worth, I think Bruen was wrongly decided.

We know. You said in Hemani that you wanted to overturn Bruen. At least you're transparent in your disdain for precedent.

>With this decision, the Court has now manipulated Bruen into a free-for-all [...] Today’s decision makes one thing clear: The Court’s objective is protecting guns, not consistently preserving any principle of law.

Emotional nonsense. The Court's objective is preserving our right to self-defense and the defense of our families when going about daily life.

>This case is about property rights, not gun rights.

This is batshit crazy. Of course it does. That's the whole purpose of Hawaii's law--to nullify the right to carry that was recognized in Bruen. It's a cheap way to completely neuter concealed carry while complying with Bruen on paper.

Invoking the racist Black Codes, which were written to keep former slaves disarmed, is an interesting move.

Jackson's nonsensical attempt to reframe this case as a property rights dispute is thoroughly repudiated by the majority's opinion:

>The principal dissent’s main argument is that “[t]his case is about property rights, not gun rights.” Post, at 6 (opinion of JACKSON, J.). Because a State is generally free to alter traditional property-law principles as it chooses, the dissent contends that Hawaii’s alteration of the traditional rule on access to private property open to the public does not infringe Second Amendment rights. This argument fails because States may not adopt property-law rules that violate constitutional rights. For example, a State may not adopt property-law rules that violate the freedom of speech. [...] The right protected by the Second Amendment is entitled to no less protection than other constitutional rights.

I'd be interested to hear Jackson's thoughts on a hypothetical state law that restricts the 1st amendment on private property held out to the public. Let's suppose a state forbids anyone from wearing a t-shirt or pin with liberal slogans without the consent of the owner. Under her logic, that's ok. But presumably she'd find some way to overturn it without even recognizing the contradictions in her "jurisprudence."

Great win at SCOTUS today, but beware of Jackson’s concurrence

Jackson explicitly stated that she wants to overturn Bruen. Her concurrence was joined by Sotomayor:

> As I and others have elsewhere explained, Bruen is un-workable. It imposes on judges the unfamiliar and difficult tasks of sifting through centuries-old evidence in order to answer “contested historical questions,” and “applying those answers to resolve contemporary problems.”

> Adding to Bruen’s weaknesses is the fact that its framework provides no clear role for this kind of tailoring discussion. But such analysis is key. Scrutinizing the fit between a challenged law’s justification and its operation is an essential part of any sensible framework for Second Amendment adjudication. In a future case that squarely presents the question, we should consider whether to retire the failed Bruen experiment and return to an explicit assessment of Congress’s ends and means when deciding the constitutionality of firearm restrictions.

Anti-2A candidate wins Dem primary in NJ’s 7th district

Rebecca Bennett, a Moms Demand Action activist, won the Democratic primary in NJ’s 7th congressional district. Her campaign policy website includes gems like this:

> Get weapons of war off our streets – it should not be easier for untrained civilians to access these weapons than it is for members of our armed forces

> Reimplement the tax on silencers to make it harder for criminals to turn their firearms into mass killing devices.

I fail to see how devices that protect your hearing enable criminals to commit mass murder, but Bloomberg isn’t paying me to say that.

Not trying to start a political food fight, but I think it’s important to highlight candidates who are advocating for disenfranchising the law-abiding majority for the crimes of the recidivist few.

The firearms industry needs to cut off blue state governments

Not content with banning the most popular rifle in America, Democrats are now banning the most popular pistol in the country. Both are owned by millions of Americans for lawful purposes; they clearly pass the “common use” test, but Democrats face no repercussions for ignoring SCOTUS case law.

Meanwhile, SCOTUS itself seems content to sit on its ass while Democrats continually ignore their case law.

It’s time for the firearms industry to step up and refuse purchase orders from blue state governments. If Glocks and standard capacity magazines are so dangerous, then it’s time to cut off purchases for state police and private security details for the legislators who pass this bullshit. No more ammo, no more magazines, no more “rules for thee, exemptions for me.” No more order fulfillments for Blue state agencies.

With the courts failing us, this is just about the only lever we have left.

Advice for traveling through MD on a motorcycle

Hi all, New Jerseyan here. I’m planning to do the Mid-atlantic BDR trip soon. This is a mostly off-road route along the east coast. I’d like to bring my EDC with me on the trip. I have NJ and PA CCW permits; I know MD doesn’t recognize those, so I’m curious what my options are. Assuming I don’t get my nonresident MD permit in time, am I good to go if I unload the pistol and store it in one of the panniers on my bike? That should be kosher with FOPA as long as I don’t stay overnight in MD, right?

Harmeet Dhillon for Attorney General

Harmeet Dhillon’s appointment as Assistant Attorney General is possibly the best hire in Trump’s second term. She deserves a bigger platform:

-2A Rights: SCOTUS seems content to sit on the sidelines as its case law in Heller and Bruen is flagrantly ignored by Democrats. Dems are banning the most popular arms in common use for lawful purposes, including semiautomatic rifles and pistols with cruciform trigger bars. In Rhode Island, they’re going further and attempting to confiscate rifles.

Before Dhillon’s appointment, Dems could pass these unconstitutional laws with impunity, while law-abiding citizens had to cobble together millions of dollars to file suit and wait decades for resolution through the court system. Dhillon’s office has stepped up and filed suits against Denver and Colorado, with the strategic aim of developing favorable case law and circuit splits.

-Woke DAs: progressive DAs across the country (Bragg, Krasner, Descano) are cutting sweetheart deals with criminals in the name of “restorative justice.” Fairfax County DA Descano explicitly directed his office not to prosecute illegal immigrants to avoid immigration enforcement. In one case, Descano refused to prosecute Abdul Jalloh, an illegal immigrant from Sierra Leone, despite a lengthy violent criminal record and three written pleas from Virginia sheriffs offices about his high risk of violent recidivism. Jalloh was released and went on to murder an innocent woman at a bus stop (Stephanie Minter). Dhillon’s office has opened an investigation into Descano

-DEI: Dhillon’s office is aggressively pursuing discriminatory DEI hiring practices, especially at universities like UVA and GMU

-Woke sports: putting on a dress does not make you a woman and acknowledging basic biology does not make you a biggot. Men should not be competing in women’s sports. Dhillon has stepped up to put an end to this

Jeanine Pirro is a disaster and needs to step down. After a favorable ruling from the DC court of appeals that struck down DC’s unconstitutional ban on standard capacity magazines, she pushed to have the case re-heard en banc, potentially jeopradizing the progress we made on this issue on behalf of lawful gun owners. I wouldn’t be surprised if she’s on Bloomberg’s payroll.

Dhillon is smart and effective. I hope her influence and platform grow
