[Texas] Appeal Hearing

Just had my appeal hearing and goddamn, that was so satisfying. little backstory, my employer denied my appeal claiming misconduct for my "excessive" health related absences. i was terminated for taking sick time because i dislocated my wrist.

I had doctor's notes, emails and evidence of no misconduct and prior times that i was compliant to their rules. one of my doctor's notes actually stated i shouldn't work the day of my employment but i logged in anyways... joke's on them because i feel like i ate down. i asked them a few questions and some of them had them stuttering and dumbfounded. it lasted exactly 45 mins. both sides got to speak AND ask questions to either party. you will get sworn in so if you say someone is lying on the record, STAND ON IT. your words have to mean something bc you're under oath. the hearing officer is obligated to believe your statement is true. i was on the verge of puking but i feel like the outcome will be positive.

my employer had my former supervisor as a witness but honestly it didn't add any more meaningful or important details than we were already knew. most of their evidence was internal communications between themselves which was totally pointless to the relevant topic being that i allegedly engaged in "misconduct".

i hope this helps someone bc i was looking for mad long on this subreddit on what it would ACTUALLY be like , in my state , with my circumstances...

Homeless not toothless

i have been searching for a new role for over two months after getting terminated for an injury and nothing. i did get a part time remote job for trademark enforcement (i specialize in IP, specifically trademarks and copyrights with about 7-8 yrs of exp.) but the market absolutely sucks balls.

i have literally been cold emailing everywhere and applying to anything that might remotely align with my experience and i'm just tired... i have bills to pay and it is sooo discouraging to keep going not knowing when a stable opportunity is gonna come by. And trust me, i have tried staffing agencies, receuiters, direct hires. Guys, I am literally overqualified. I wish I could share my resume but you get the gist. anyways, not sure how much longer i can hang on but believe me, i just want to let myself fall.

[Texas] Don't lose hope , call them.

Hi you all,

I recently was terminated by my employer due to health/medical reasons. They told TWC it was because of "misconduct" so subsequently they denied my claim. I appealed a day after they gave me my denial. I have been waiting about 6 weeks now and have been facing eviction amongst other financial hardships so I needed TWC to escalate my appeal hearing a bit faster. I emailed and called my state's Senator office and they reached out to TWC to inquire about the status of my appeal. TWC called and texted me directly and I was successfully able to have them request an expedited appeal hearing. It was simple and I'm completely grateful.
Just thought I'd share my story so far as some sort of encouragement. Now let's pray that I win! 🤞🏾 God bless.

Edit: I checked my portal this morning and they have finally scheduled my appeal hearing for the beginning of July!!

what to do now ¿¿

To make a long story short, a few months back I took a remote job out of desperation because of course, our bills don't stop. It was for a "big law" firm so I already had preconceived notions due to my prior firm also being big law. BUT I needed money to sustain what I've acquired so far. At first, it was really exciting with the exception that the micromanaging during "training" was just downright weird. They suck at training employees and offering additional assistance unless you like getting talked down to. Never again.

About a month or two in, I dislocated a bone in my left wrist which I had no idea til I got an x ray at an urgent care due to the extreme discomfort I experienced while I was typing during work hours. I mentioned this to my supervisor and my attorneys on separate occasions because work was fast paced (I have about 6 years of experience in IP). No accomodations were made so I had been using my sick time/PTO sporadically bc working was not allowing me to let my wrist heal properly and honestly the pain was super unbearable some days. I was consistently asked what my specific medical leaves were for (which is not permitted) and when I pushed back asking if a doctors note was needed (because I had one), I received no response.

Fast forward, I was fired shortly after asking/telling HR about the numerous calls and inappropriate questions from my supervisor a few weeks ago due to me using my PTO. I filed for unemployment asap and the firm are such assholes that they are trying to block me from collecting on my claim by saying I was fired due to misconduct. Now I have to wait for my appeal hearing which has been taking weeks and due to their opposition, I am facing eviction, loss of income, and just overall turmoil... not to mention I have also lost a baby during all of this. I took a leap of faith to move states for this opportunity and I guess I'm just really distraught and disappointed. I have no support here and I'm already financially anxious to begin with but I have been job searching for about two months and still... nothing. What would you all do in this position? How can I make fast or easy money without transportation? I feel so useless not working and just need a job. :(

Took me awhile but I'm over it

After experiencing both law firm and in-house environments, I genuinely don’t think I can do law firms anymore...

I used to think the constant anxiety, rigid personalities, micromanagement, and walking on eggshells was just “part of legal.” Being questioned over taking PTO, feeling like asking a question was an inconvenience, getting little to no training but somehow being expected to magically know everything, attorneys speaking to staff with unnecessary attitude or condescension, and the overall culture of stress being normalized for support staff.

Then I experienced environments where people actually communicate normally, collaborate, and treat legal staff like professionals instead of liabilities.

Interesting how much better people perform when they aren’t being managed through fear, hierarchy, and pressure 24/7.

Curious if anyone else who went in-house realized how unhealthy certain law firm dynamics actually were once you finally got out.
