Scenario 2: She was creeping out from the stop sign, taking more and more of the roadway while checking for traffic. Because it was raining and she appeared to be continuing into my lane, I instinctively swerved to avoid her, but she still hit me. The swerve was an emergency reaction to her moving into my path rather than me casually deciding to drive around her.

It happened in a split second, and I don't know which scenario is correct. I'm the asshole if she's aggressively pulling in, checking one side anyone, i have the lane and swerve around to get by her thinking she'll notice, but she drives in anyway?
