BMW Claims Radar Detector Suction Cup Broke Windshield

My windshield randomly cracked from the corner of the windshield to the middle of the windshield. BMW confirmed there is no sign of impact that caused the damage.

The dealership had the car inspected from the master tech (BMW North America) to have the windshield swapped out as a warranty claim, and his denial reason was from having my radar detector mounted to my windshield, and the suction cup was too much stress. Please see pictures…

I called corporate and their appeal process is to literally ask the same person who denied the claim, and he confirmed he believes the suction cup caused the damage, and therefor it’s an outside source.

The dealership wants over $2k to replace my windshield, and even the dealership said they have never seen this before.

BMW NA said there is no one else I can speak to, or anything that can be done. They are literally holding firm that my little suction cup caused the windshield to break.

What can do I do here? Who do I email? Who do I call? I’m not going to pay on principle that they actually think a car windshield is fragile enough to break from a suction cup.

Thanks!

Windshield Stress Crack - BMW claim my radar detector cracked my windshield.

My car was parked in my lot and the next morning I woke up to a huge crack from the corner of the windshield to the middle. There is no sign of impact, which was concerned from BMW.

Since the car is less than 1 year old, I’m hoping BMW would replace the windshield under a warranty claim since they confirmed they don’t see physical damage.

They gave me a loaner since they wanted the master mechanic to look at it, and they called me today that the warranty claim won’t be approved since “the suction cup from my radar detector caused the stress to crack the windshield” per the master mechanic.

The crack is from the corner of the windshield to about 3 inches from the radar detector.

I find it insulting that they are telling me the little suction cup broke my windshield, even though the crack is starting at the side of the Windshield working its way to near my radar detector.

Anyone have any insight or recommendations?

They want $3100 to replace the windshield.
