et me start out by saying there is no custody agreement in place. My SD is five I have been married to DH for three years this month have been in her life since right when she turned two years old BM and I get along OK it’s been a rough road, but we communicate well Her and DH we’re never married. DH is on the birth certificate, but does not have paternity established in the court. There’s no child support no custody order. None of that never been to court. BM has only had SD about 10 nights since the end of September, she’s been to Jail, rehab, and she also has an active warrant for running from court on a drug charge, a felony.
That’s the backstory, here’s what is causing us to feel the need. We need to get an emergency custody order. BM has a different man every week. She lets them stay at her house and yesterday she pulled up to get SD with a guy driving her vehicle who SD said, tried to whoop her last time she was over there. So DH was not going for it. He told BM no she’s not going. I feel like it’s an unsafe environment. He walked SD back in the house and BM followed behind. We have cameras in the doorway and behind so we had two different angles of this confrontation when he got in the house, he was holding SD and they were cussing each other back-and-forth, and she pulled out a gun out of her shorts. I don’t think she realized well, she couldn’t have realized how close that gun was to SD when she whipped it out. She only had it out a few seconds as soon as DH solid. He turned SD around and put her down and told her to go in the room. BM was screaming. I will k!ll you right effing now. As I said, I have all this on video. Does anyone have any experience with getting an emergency custody order when paternity hasn’t been established in the court, they’re not gonna try to take SD are they? She’s been with us 85% of the last three years her school doesn’t know who BM is her doctors office and dentist office. Don’t have a clue who BM is. I do everything for that child. DH literally got laid off from his job yesterday. I do a call center job remote work from home. It was just extra money because DH made great money.
Let me add in that we do not have the money right now to pay thousands of dollars for an attorney. Any advice or words from experience is welcome.

*****edited to say we did call the police immediately and they took the report over the phone. The courthouse was closed at that time so we go pick up the report Monday order from the sheriffs dept then take it and the videos to the courthouse *****

So Thursday night DH was on the phone with SD5 and BM started yelling at SD and DH got all over her tell her to stop talking to her like that so BM went and started Calling him all kind of B word and just the most terrible of the terrible. So then Friday afternoon, she comes to pick up SD to spend the night with her (she’s only had her 10 nights all year) and she’s got a random guy driving her car that was obviously intoxicated. So DH was like no come get her later. I’m not sending her right now. This is the third dude you pulled up within the past two weeks. I don’t feel like that’s a safe environment for her and she went and started calling him all kind of names. He had come through the door and she pulled a pistol out of her shorts and drew down on him while he’s holding SD. So he turns around real quick and gets SD out of the way then BM puts it back in her shorts all this happened in the doorway of my house. We have it all on video three different angles. We have her saying I will kill you right f’n now. Y’all when I say this was insanity.
The old lady in me knows number one that I’m too damn old to go to jail and number two. That girl wasn’t gonna do nothing with that pistol. She was just barking like the dog she is.
My husband said he’s proud of both of us for not dragging her in the house and whooping her tail. Emergency custody order coming with those videos Monday morning! Not to mention she has a warrant for running from court on a felony drug charge. There is no custody agreement in place and he has not established paternity with the courts, but he is on the birth certificate and SD has resided with us almost exclusively for 3 1/2 years now and we have proof. The school doesn’t even know who BM is her doctor and dentist have no idea who she is.
Does anyone have experience with getting custody granted before paternity is established when it’s an unsafe environment at BM house?

I am seriously up at 3am on the website overchargedforbeef.com filling out this lawsuit. According to my Walmart history, I have purchased 389 pounds of beef.
This is a no proof settlement so run and fill it out. I know everybody has bought some beef. Only eligible in certain states. 🏃

And then how many of you contacted Blue Cross Blue Shield one on one directly and paid your payment directly to them each month? Not taken out of your paycheck you wrote a check or paid by credit card directly to Blue Cross Blue Shield every month.

So SD5 who I have enrolled in school, dropped off and picked up every single day, take to doc, take care of when she’s sick 🤒 I mean I’m the primary caregiver. In 3.5 years she’s been with me 80/20. BM in and out of jail., rehab the works.
So she gives me this binder that she’s been making all year at school she’s in pre-K every month has a handprint and a different picture made out of it and what they mean. And she tells me happy Mother’s Day. This is for you. I cried like a baby. It was so sweet.
Then she gets on FaceTime with Disneyland, BM and the binder is on the bed and I’m moving and she goes well that was supposed to be for my mama. My Goddddddddd

So I purchased a phone from AT&T and it says it is SIM locked. When I put my Boost Mobile phone next to it it let me bring my number over to the AT&T locked phone. I had already checked compatibility on the boost website and it said the phone was locked and not compatible with boost, but I had no issues bringing it right over and downloading an eSIM. Phone still says sim locked in settings. Just using my boost plan under 2nd imei. I’m confused.
Am I gonna wake up and my phone doesn’t work anymore
