Legally speaking, Iran signed but never ratified the United Nations Convention on the Law of the Sea (UNCLOS), therefore it is not bound by the transitional passage treaty.
The UN defines sovereign waters as 22 km from the coast. T Hormuz is 38 km wide. That gives both Iran and Oman sovereign rights over the strait, with each country controlling about 19 km. Furthermore, as coastal states, Iran and Oman have authority to regulate foreign ships in their territorial sea.
Furthermore, under transit rules, ships belonging to states engaged in armed hostilities can be denied passage. That includes the U.S. and Israel and others who supplied logistical assistance to hostilities against Iran.
But let’s dive into how we got here. Iran spent nearly half a century as one of the world’s most heavily sanctioned countries, facing extensive economic restrictions. The sanctions were so severe that even the supply of medication into the country was affected as pharmaceutical companies did not want to risk getting into trouble with the US.
Iran has also suffered through two major wars started and instigated by the US and Israel that has caused thousands of casualties and enormous economic damage.
During this war, two nuclear armed states made threats to end Iran’s civilisational and return Iran to the stone ages. These were clear threats of a nuclear strike.
Iran also dealt with regional instability spilling over from the wars in Afghanistan and Iraq led by the US and NATO.
Despite Iran being heavily restricted in exporting its own oil, Iran never closed or restricted the Persian Gulf to prevent Gulf Arab states allied with the US from exporting theirs and taking advantage of Iran being cut out the market.
Decades of sanctions and hostility have consequences. If the international community wanted uninterrupted, cost-free access to one of the world’s most important shipping lanes they should have unanimously opposed the sanctions and wars imposed on Iran.
The objective of managing the Strait is not primarily to generate revenue, but to create a credible deterrent against further coercion.
