[California] If an employer issues paystubs for a Terminated employee for many months after job ended, resulting in felony criminal charges for unemployment fraud (double dipping since employer deemed person was "still employed" ) could that employee sue?

Could the former employee have a case for negligent employees record keeping perhaps? Argue the paystubs were issued without allowing that employee access to them?
