I was in a deeply toxic (arranged) marriage for over a decade. My husband was financially irresponsible, rarely worked consistently, got involved in gambling and other questionable activities, and I ended up being the primary earner (working remote) while also raising our two children.
Things escalated badly over the years. During one major fight, he pronounced triple talaq in anger. After that, I moved back to my hometown with the kids for safety and stability.
I had reason to believe he was planning legal action against me, so I filed a domestic violence case based on genuine incidents and evidence. He has now responded by filing an RCR (Restitution of Conjugal Rights) case against me. He is extremely hot headed and I know if i go back to him in going to end up dead.
I’m trying to understand what usually happens next in situations like this in India. How do courts generally view DV + RCR counter-cases? Can both run simultaneously? What should I realistically expect moving forward?
The DV case is running in TN and the RCR in KA
Would appreciate insight from anyone who has gone through something similar or from lawyers familiar with family law.
