Didn't Ask for Rent Concession

I made a dumb decision and hope someone else can learn from my mistake.

My partner and I found an apartment that tics nearly all our boxes. After we were approved, the broker asked if we'd be willing to do a 2-yr lease (listing said 1 yr). I talked it over with my partner: while risky for a new place, complaint/ violations history seemed fine and a guaranteed 0% increase for the 2nd year was appealing. We accepted, but I see now that I wasn't thinking well under pressure. In hindsight, its obvious that we should have asked for a rent concession. I don't think there was a ton of competition, given how long the process took and how pushy the broker was for us to sign. And on SE, longer leases often have concessions. We had leverage and didn't use it. At worst, they would've just said no.

I love the apt! it's a small building and I've spoken to neighbors - they seem happy overall. But I keep kicking myself for not being more savvy, esp with how expensive moving is.

Has anyone been successful negotiating something like this?

- Big windows and lots of natural light

- Easy street parking if you have a car.

- Close to multiple grocery stores & bodegas Baby Cobra Yoga, 3 Dollar Bill, Win Son, L Train Vintage, Sleepwalk and lots of other great food, shopping, nightlife, cafes etc

RENT STABILIZED $3863 - East Williamsburg - 1BR w BIG terrace - Avail ASAP

I've loved living in this apt! But am moving in with my partner and their cat. Previous tenants were a couple and there's at least 1 other couple in a 1BR here, so it is doable. I'll move out 6/19 and management says it'll be 3 days to clean, paint etc

- Pets allowed

- Deep tub in spacious bathroom

- BIG private terrace, great for hosting! There's also a shared rooftop w furniture. My family & I watched July 4th fireworks up there and had the whole roof to ourselves

- Storage: big bedroom closet, coat closet, plenty of kitchen cabinets

- Top floor of quiet building.

- No pests in the building! I _rarely_ see any rats outside either - the small gang of outdoor kitties is doing a great job of keeping them away.

- Close to multiple grocery stores & bodegas Baby Cobra Yoga, 3 Dollar Bill, Win Son, L Train Vintage, Sleepwalk and lots of other great food, shopping, nightlife, cafes etc

- Big windows! Liv rm gets great light in the a.m. and bedroom gets a lot in the afternoon.

- Easy street parking if you have a car. I _think_ there are garage spots for additional fee, but I didn't find it necessary.

Broker Fee - Should I just not pay it?

TLDR: I was asked for an illegal broker fee, but I haven't paid it yet and now I got the apt. Should I just not pay?

I toured an apt I found on Street Easy and when I reached out for the application, the broker (Barry Shor, StayBK) told me there would be a $300 "processing fee" due upon approval. I asked what it was for and if it would be applied to my rent. His response: "this is a separate fee that is paid at lease signing , it goes towards our office for all the Backoffice work until your move in date" So a broker fee 🙄 I even referred to it as such and he didn't correct me.

Now I'm basically done: lease has been signed and countersigned. I got the welcome email from building management and set up my tenant portal acct. Tomorrow I'll submit security & 1st month. Fri they'll give me the building entry code so I can pick up the keys.

Barry hasn't mentioned the fee since I called it a broker fee lol If he asks for it, I don't think there's any risk in not paying since the application process is done and I don't need him anymore (not that he was doing much). Is there anything I'm not considering?

This is pretty small as far as broker fees go, but still annoying and illegal. I initially figured I'd pay it then file a complaint and see if I could get my money back, moreso out of spite than anything lol

  • Security deposit is 1 month rent
  • Utilities included
  • Ground floor in a small building ( there are a couple steps just inside the building )
  • Bedrooms are on opposite ends.
  • The tenant you'll be replacing was able to fit a full bed, dresser & some side tables in the room.
  • Spacious, eat-in kitchen with separate living room
  • 3 blocks to Seneca M, 5 to Myrtle-Wyckoff M/L
  • 1.5 blocks to 2 laundromats: new, 24-hr or mom & pop, coin-operated
  • Small grocery right next door. 4 blocks to Food Bazaar
  • Walkable to Topos bookstore, Tiny Art Supply, Bakeri, Julia's, Salty Lunch Lady, Aunt Ginny's, Ridgewood Commons... so many great food options, shops, bars etc

Your future roommate: 34-yr-old queer/ nonbinary cat parent who works in a restaurant (so typical late/ long service industry hours).They're quiet, friendly & creative.
