The only way BaM wins is if Ben settles... hear me out...

1. If BaM wins the civil case...

Then Ben will post all his evidence and footage online and completely destroy BaM's brand. And BaM will lose more money than they would get awarded.

2. If BaM loses the civil case...

Then Ben will post all his evidence and footage online and completely destroy BaM's brand.

3. If BaM just gives back the LEGO set...

Then they lose a lot of negotiation power because that will fulfill Ben's goal.

4. BaM's only path to victory is getting Ben and Bryan to sign NDA's...

Why?

Because Ben has evidence of their corruption and how they mistreat customers. This could destroy a company (and the only one's to blame for that would be BaM... next time don't be dbag fraudsters).

Preventing that info from coming out is the only way BaM would have a chance of surviving. Because then BaM would control the narrative and rewrite history.

Ben has multiple paths to victory... some more expensive than others...

If Ben wins the civil case, he gain more street cred and further solidify his brand as a content creator $$$. Yet, the court costs and hassle will be expensive but the community is behind him.

If Ben loses the civil case, he gains more street cred and further solidify his brand as a content creator $$$. Yet, this will be the most expensive route BUT his career as a YouTuber will be set (unless he lied to us like Karl Jobst which I highly doubt Ben did).

If Ben gets the lawsuit dropped, he gain more street cred and further solidify his brand as a content creator $$$

The only way Ben loses...

is if he settles and signs a NDA. Yes, he'll avoid costly litigation and headaches. But he'll always be known as that one YouTuber who had a corrupt corporation dead-to-rights yet folded in the end. AND he'll lose the ability to publish this story and BaM will rewrite history to make Ben out to be the villain.

Ben's largest bargaining chip is his freedom to publish content about BaM. And BaM is trying to convince Ben into believing this bargaining chip is worth less than their law-fair.

Short term, settling w NDA is the cheaper route but will not advance his career.

Long-term, if he does not sign a NDA, then he'll be a legend journalist $$$

It's called the Kafkatrap. Basically no matter what you say or do, the attacker will always interpret it as an admission/evidence of guilt.

Here's an example of how cops use it during a stop:

  • Cop: "Where are you coming from?"
  • person: "From a friends house."
  • Cop: "Oh, were you drinking or doing drugs?"
  • person: "No" [person actually did not drink or do drugs]
  • Cop: "Really. Then why do I smell weed?" [cops are allowed to lie and make shit up]
  • person: "what, i dont smoke." [person feels urge to defend himself]
  • Cop: "Prove it, take sobriety test." [cop already establish sense of guilty, now he's leveraging that to manipulate person into taking actions to further incriminate himself]
  • person: "No"
  • Cop: "Why not? if you really didn't smoke, then you have nothing to be afraid of. [cop manipulating person into proving his innocence even though cop has no evidence of a crime]

We see cops do this shit all the time! and maybe you've had it done to you by a pig (I know i have).

I bring this up because I replied to comment in another post about the AFPD corruption in how they treated Ben on this sub. In that comment someone brought up how you should not talk to police. I replied regardless if you do or don't, they'll still treat you like a criminal and try to kafkatrap you. Original Comment

People in general, especially YouTubers like Ben, would benefit from learning what kafkatrap is and knowing how to call it out when it happens. Putting a name on it gives us more power to fight against it.
