According to reports on Korean Media; Oh Young-soo had been indicted in November 2022 on charges of forcibly molesting a female theatre troupe member twice in 2017 by allegedly hugging her and kissing her on the cheek in front of her residence. While the first trial FOUND HIM GUILTY and handed him an eight-month prison sentence suspended for two years, the appellate court overturned the conviction and ACQUITTED him. The Supreme Court has now upheld that acquittal by dismissing the prosecution's appeal.

In its ruling, the appellate court stated that "the recognition of a criminal fact must reach a level of proof beyond reasonable doubt," adding that "when there is doubt, the benefit of the doubt should be given to the defendant."

The court further ruled, "There is suspicion that the defendant (Oh Young-soo) may have sexually assaulted A," but added, "It appears possible that A made the victim statement due to memory distortion."

Regarding the alleged hug, the court stated, "It appears that the act of hugging itself was consented to by A," and added, "It is difficult to consider the crime of indecent assault established solely on the grounds that the intensity of the hug was severe, contrary to A's expectations."

On the alleged kiss, the appellate court said that "the burden of proof to determine the credibility of the victim's testimony lies with the prosecutor," noting that "no investigation was conducted into the duration the sensor light was on or the possibility that the light would turn off when the password was entered."

The court also addressed Oh Young-soo's apology message, ruling, "It appears that the defendant understood it to mean that if he apologized, the issue would not be raised any further," and adding, "In the context, there is a high possibility that the apology was vague overall."

Song Ha-Yoon Bullying Lawsuit Dismissed by Police

Actress Song Hayoon, who filed a defamation lawsuit against an alumnus who accused her of school violence, has had the case dismissed by the police. The ongoing case may finally be coming to an official close.

According to Money Today on June 25th, the police decided not to forward the case that was filed on February 19th regarding defamation, obstruction of business, and threats filed by popular actress Song Hayoon against an alumnus identified as Mr. A.
The police determined the defamation charge was “not a crime” and cited insufficient evidence for the obstruction of business and threat charges, leading to an ultimate decision of dismissing the case. There was no substantial evidence ruling it as “not a crime,” which cases are usually made when an act may fall under the elements of a crime but is legally unpunishable due to specific reasons.

Previously, Mr. A appeared on JTBC’s Crime Chiefin April 2024, claiming that in August 2004, when he was a sophomore in high school, Song Hayoon slapped him for about an hour and a half. He also alleged that the star was involved in a group assault incident and was forcibly transferred to another school.
At the time, Song Hayoon’s side vehemently denied the allegations, stating, “I have never met Mr. A, and I have never committed any acts of violence. I was also never forcibly transferred to another school like Mr.A claims.” After hearing the allegations, Song Hayoon soon later announced plans for legal action in order to retaliate the charges.

Meanwhile, Song Hayoon’s side has filed an appeal against the police’s decision not to prosecute. Consequently, the prosecution is reportedly reviewing the case again as of now.
