Where i live if a private company boots your car its reliant on implied consent.
As in their is some sort of signage clearly visible that is an implied contract you agree too.
What if you had on your vehicle a sticker informing all persons who apply immobilization devices to your vehicle that you will remove it at their expense and you charge 150$ for the service?
Because they imply you agreed to a contract by entering the parking lot since the sign exists.
But if on your car you have a declaration of similar implied consent.
Then who's to say you cannot lawfully remove any immobilization devices and charge them 150$.
Because they contractually agreed to it by applying a boot despite your clear signage.

Gratuity = Favor / Gift
Tip = A Gratuity for services provided.
Not a payment for services provided.
A optional gift above what is owed.
A Gratuity cannot be an obligation definitionally.
Gratuity involves free will, Payment is coerced.
If something is given under obligation it is not a gift its a payment.
And making people THINK they are obligated is different than people being obligated.
Thats why restaurants write their prices down.
Because if they didn't people would argue about what to pay.
If a restaurant didn't disclose a price to eat and left it up to gratuity,
Paying nothing is not wrong. They may decide that doesn't work for them and ban you.
But their business model allows for that.
If you work for someone who expects you to get paid by his customers.
But he does not disclose this mandatory obligation to the customers through the menu contract.

Tipping is a system that business's utilize to make more money.
Not all businesses are successful at utilizing it.
Doubtful many people want to pay their contractors extra.
Doubtful they want to pay extra for groceries at the cash register.
Doubtful they want to pay extra for building materials at the cash register.
Doubtful they want to pay extra for the garbage man's service.
Doubtful they want to pay extra for the teachers service.

But a restaurant has baked into our culture that we need to pay extra or we are shameful.
Predatory Business Practice
Restaurants can pay their servers above minimum wage without menu price bloat.
But because servers have a solid gig to earn 50-100/h on some days.
They definitely prefer that to getting a normal wage that doesn't compel tipping.
Because no employer would pay anywhere near what they extract from customers.
Its a system build of expectation and societal conditioning.
Its not people feeling additional value from the service.
Many people feel they already paid to have their food and beverages they paid for carried to the table.
And they see the business trying to extract 20% - 25% extra as predatory.
Yes they hide behind we underpay our staff so please pay extra or they will mistreat you.
But the idea we need to overpay for food then overpay for the person who places the order and carries it to the table.
Its too much. Its predatory. tipping is predatory its not actually gratitude its manipulation.
People feel manipulated to tip because culturally conditioned too.

I find it interesting that most people argue that menu prices would be signifigantly higher if servers were paid appropiately by their employer.
But The cheesecake factory in California only charges 1 more dollar for advocado toast than Texas.
We can actively see what a corporation has to do to afford paying servers.
An Example of guilt tripping
Notice that the server feels entitled to a tip and the person did not pay an optional gratuity.
The server decided that publicly shaming the person for not giving them a gift ontop of the bill was appropiate.
They did this in hopes of shaming them into paying extra ontop of the bill.
The greatest scam
The government and business are in cahoots with employees to extract extra value from customers.
They purposely engineer it so that a certain class of worker is underpaid to guilt trip and shame customers into paying extra.
The business is basically like
"Look i cant afford to pay my employees but im making them do work for you. I know the contract doesn't say you owe more but we will psychologically pressure you to pay extra."
Already overpaying for the food. they are charging as much as they feel safe charging.
New Restaurant Model
I believe that we can do away with most server positions by having a tablet.
A tablet for each customer at each table to make food and drink orders.
Then you have bussers to bring that food out. Or perhaps they are also the customer service end of the restaurant.
But they no longer need to check on their customers because the customer can just digitally inform the restaurant of any requests.
Would improve dining experience.
Would reduce need for unpaid labor.
Its ok to not tip.
Server's don't like to tell you, but their job pays really well. They probably make more money than most employees at any job if their any good.
You don't need to help them, most people will keep them making a very decent wage.
They will all say they are underpaid.
if customers are paying anywhere near 15-20% out in tips its not hard to estimate how much a server is making if you see how busy a restaurant is.
If they manage 7 tables and even average 50$ in sales per hour per table, They making more than most.
