The requirement that Ian had to mention “snark” wasn’t actually in the signed settlement

The formal settlement between Ethan, Ian, and Anisa apparently did not actually say Ian had to use the words “snark” or “H3 snark.”

Ethan’s side was negotiating the “snark” requirement via email, it was kept separate from the formal settlement. Ian’s lawyer pointed out that the final signed agreement gave him discretion over his wording, and his apology did address the same online behavior without explicitly calling it “snark.” The judge didn’t really rule “Ian failed to mention snark and breached the deal”, it was that the settlement was too vague to enforce in the first place as it wasn’t in the formal agreement.

If the exact content of Ian’s statement was important enough to Ethan to determine whether the lawsuit would actually be dismissed, why keep that requirement outside of the formal settlement instead of writing it directly into the agreement? To me, that seems like an obvious setup from Ethan. I don’t think he ever really wanted this case to go away.

Not a lawyer btw, this is my reading of the court notes that were posted.
