[Megathread] Decisive Victory in Federal Right to Make Firearms Case

BREAKING NEWS: the second major legal victory in as many weeks, a federal judge just issued summary judgement for the plaintiffs in Defense Distributed v Blanche, better known as the VanDerStok case. This victory eliminates the ATF's 2022 "ghost gun" rule change and establishes that the 2nd Amendment covers the "right to make or repair personal firearms."

It's important for the 3D2A community to understand what this means for them, and what it does not.

As with all breaking legal news, this will take time to understand - the information below comes from conversations with my legal contacts, public reactions from other 2A legal figures, and my own read of the decision.

1. What does this decision do?
This decision pertains to the 2022 Biden ATF frame or receiver "final rule," which among other things redefined "firearm" an extremely broad, vague definition which includes unfinished frames / receivers ("80 percenters"), parts kits, combinations of parts sold together and more. The effect was to broadly expand the ATF's ability to regulate (most notably to require 4473s and serialization for) products that, up until that point, had not been considered "firearms".

This decision declared that ATF's "final rule" was unconstitutional under both the 2nd and 5th Amendments. It provides both injunctive and declaratory relief.

The injunctive relief prohibits ATF from enforcing its "final rule" against the named plaintiffs for certain products. But, and unlike the NFA case, this case features declaratory relief that much further establishes the unconstitutionality of the "final rule," prohibiting the federal government from enforcing the rule in any way.

2. How was this decision reached?
The court declared that the "final rule" was unconstitutional under the 5th Amendment due to its redefinitions being excessively vague, which is a violation of 5A's Due Process clause. The extreme broadness / vagueness of the ATF's new definitions "[did] not provide fair notice of what is punishable and invites arbitrary enforcement."

More notably for us, the "final rule" was found unconstitutional under the 2nd Amendment because it unacceptably infringed on the "right to make or repair personal firearms", which the court declares is covered by the text of the Amendment. The court further affirmed that a Bruen analysis reveals that homemade firearms are central to the American tradition and that there is no history or tradition of regulating them.

3. What will the effects be of this decision?
The immediate injunctive relief allows the beneficiaries (listed below) to buy and sell four different products. This is quite narrow and so we can ignore it.

The declaratory relief is (at least in theory) far broader and far more important for us. By declaring the "final rule" unconstitutional, ATF is now on notice that they are constitutionally prohibited from attempting to enforce this rule. Language is included that can be read to say that this relief is "as applied" only to plaintiffs, but the broader fact remains that black letter now exists declaring that Americans have a right to make, and that the ATF cannot constitutionally infringe upon that.

4. Who does this decision cover?
Like the Silencer Shop NFA case, the injunctive relief is quite narrow, covering only the plaintiffs: Defense Distributed, Second Amendment Foundation (SAF) and SAF's current and future members.

The declaratory relief however, may be read as broadly as possible, and is at least useful as authority to any American who wants to buy, sell, or make a firearm.

5. What does this mean for 3D2A?
If this decision only included the injunctive relief, it would be a curiosity at best - but its practical and legal importance may go much further, accomplishing something that the DIY firearms movement has been fighting towards for its entire existence. This decision is one of the first to establish in black letter that the 2nd Amendment includes the right to make (and repair!) firearms.

This doctrine goes well beyond 80%s - it touches on all forms of making firearms, and all types of firearms - including items legally determined to be firearms, such as suppressors. The significance of this cannot be overstated.

All US laws, state and federal, that might infringe on this right, are now subject to constitutional challenge. For example, there are multiple right-to-make cases in California which will benefit from this ruling.

Despite the narrowness of the injunctive relief, I expect that the declarative relief will lead to the revival of the 80% market in some form, which may be of interest to many 3D2A members whose interests are not limited solely to printing their guns. But more importantly, our community can now correctly argue that any existing or proposed law which would impede our ability to privately make firearms is facially unconstitutional.

6. Does this mean I can start printing machineguns now?
As much as this is worth celebrating, I want to conclude by tempering expectations. This decision does very little for the average 3D2A member in the immediate here-and-now. Most of the laws that limit what we can make are still on the books. If you live in a restrictive state, your state laws haven't yet disappeared.

Parts kits vendors such as myself, who have always had to consider the "final rule" in how we structure our kits, are more immediately affected, and you may see new ways of doing kits coming in the wake of this decision.

The broader practical effects of this decision will be more long-term. By all means, celebrate it - this, and the NFA decision, are two of the biggest victories the DIY gun community has experienced in decades. But celebrate safely, and keep your powder dry. The best is yet to come.

Any safety reason why this wouldn't work?

EPC-9 Upper with 10.5" Faxon 10mm barrel and KVP 10mm BCG, All fit perfectly into the upper for the EPC-9, on an AR45 lower

I wanted LRBHO that's why I used the EPC-9. I also had an aero hanguard. I can't find any information or threads of anyone building a 10mm specifically using the EPC-9 Upper with LRBHO. I mean the BCG sits flush, the trigger resets, the BCG doesn't hang up anywhere when charging, the LRBHO lever sits exactly on the 10mm mag follower where it would on the 9mm and the function works, snap caps feed just fine. Just wondering for anyone that knows more than I do, don't wanna send shrapnel into my firearms idk I'm just thinking of worst case scenarios. And according to AI none of this should work but idk how much to trust Google AI, to which none of the answers it gave me hinted at dangerous pressures, if anything I'd probably have ejection issues but that is only my best guess. I guess the only way to find out is to shoot it which I haven't done yet. Also I don't have sights or muzzle yet as you can see

M&P 2.0 Compact/Fullsize mag help

Well I goofed up and probably wasn't paying attention but I accidentally bought Colorado-compliant 15-round M&P 2.0 Full Size mags, when I meant to buy it for the compact and would fit without needing a mag sleeve. But since I already made it this far, I might as well make these the full-size 17-round. The mags come with extra spring material which acts as the limiter.

Would anyone please share a photo of your 17-round mag spring so I can count the coils and I'll cut mine to fit, pretty please. Thank you

[TOMT][VIDEO] Guy gets his pistol stolen from hoodie pocket while out in public

The video is shot in 3rd person "prank" format where the cameraman is a distance away maybe across the street, so it could be a fake vdeo but nonetheless, a black man wearing I think a black hoodie, maybe he was walking or standing when suddenly someone, I think another black man, from behind the 1st man, reaches and grabs a pistol that was hanging/dangling out of the 1st man's front hoodie pocket

To which the 1st man starts to plead and beg the thief to give his gun back, saying things like,

"please gimme back my burna bruh"
"I can't go back to my city"

And basically just repeats those phrases over and over

And the the man proceeds to practically get on his knees in prayer hands, constantly pleading with the thief. The video or clip is probably like a minute or two long

The thief is likely the social-media influencer/uploader of the video, it's likely staged but idk, video is probably a couple years old at this point cuz I can't ever find it

The video is NOT:
Black guy gets his gun stolen from his hoodie pocket while he is asleep on the bus, filmed by thief (POV)

White guy gets his gun stolen from the back of his pants at a gas station, filmed by surveillance footage

Families nearly struck by stray bullets in Arlington, WA | FOX 13 Seattle

Guns were fired in a legal shooting area but negligence and an insufficient backstop caused bullets to hit two houses with children nearby, including a glass door and a computer monitor. You can literally hear a bullet whizz at 1:09. Could you imagine if you were sitting at that computer? So irresponsible, when you miss your target/backstop those bullets have to land somewhere, you can't just shrug it off like 🤷‍♂️"out of sight out of mind" No dude. This doesn't make our community look so great, but more importantly people's lives were in danger. Please for the love of God be responsible, follow your state's laws, use a proper backstop and follow the 4 rules of gun safety. I'm gonna stop talking now but in my opinion the perpetrators should at the very least be fined or something because it sounds like they know who did it and where it came from idk

Public land trekking

So I guess not really gun related but I guess could still be. Here's a video of a guy doing literally what I had in mind So let's say you drive out onto a dirt road in the forest that is surrounded by public land, are you allowed to park your car (given that you're not blocking the road) and then hike into the forests to the left/right? I mean it's public land, in the beginning of the video you can see their car parked and he literally just walks into the woods which is what I had in mind

Wish someone would make some FPC 22lr/M&P 22X magazines

I know I sound pretty selfish by asking and not contributing but my laptop can barely run blender or fusion 360 and will basically crash every time otherwise I would take a stab at it. Just hoping that someone will eventually do it and we get to have oem and extended mags

Problems downloading from the sea?

Is anyone else not able to download any files off the sea? It's been like that for a few days for me, I click download and it prompts me to a window saying "try again later." It does this despite the browser chrome vs edge, incognito, non-incognito, VPN connected/non connected

[App] Copy/paste links from Reddit in mobile web browser not working in app [2026.18.0.]

This seems more like an entirely removed feature rather than a bug, but you used to be able to copy the link to a Reddit post via the mobile browser, like chrome, and paste it into the reddit app search bar and viola you were taken into the post via the app. No longer works. What a shame to get rid of such a useful tool. Very frustrating please add it back.

I don't always make the best decisions. But I bought mine in 2024 after deciding I wanted a .22lr pistol. Did all my research and the decision was between the TX22 and the Ruger mark IV. Chose the TX22. I think i spent $300 or something like that

Didn't take long for the fun-mode to come out after that

Now if only I can find OEM barrels in stock
