Security deposit- A major crisis!!

Advocate here. Bangalore has an unspoken rental problem that most tenants realise only after they vacate the house.

In my experience, I have not seen any other city where withholding security deposits is so common and so casually accepted as it is in Bangalore, Mumbai may also be on the list

Yes, there are genuine cases where tenants cause actual damage and landlords are entitled to deduct from the deposit. But in most cases I handle, there is not even minor damage and yet the deposit is still withheld without any explanation. Over time, this has started to feel like an unwritten rule among landlords here.

Just today, I sent a legal notice for a tenant whose security deposit has been stuck for seven months even after peaceful handover of possession. Interest and legal costs had to be claimed not because the tenant wanted to fight but because silence was treated as consent.

This is not a rare issue. It happens regularly.

One simple takeaway for tenants

A casually drafted rent agreement or one copied from the internet often costs far more than it saves. Clauses on security deposit deductions timelines and handover decide whether your money comes back or quietly disappears.

My genuine advice to tenants is to get the rent agreement drafted by a competent Advocate before moving in. And if your deposit is already being wrongfully withheld consult an Advocate and send a legal notice. In many cases once legal consequences are clear the deposit does get returned.

Most people do not think about this until it happens to them.

My advice to tenants: have your rent agreement drafted by a competent Advocate before entering the premises. And if your deposit is already being wrongfully withheld, consult an Advocate and issue a legal notice seeking refund with interest and costs in many cases, legal consequences prompt compliance.

Most people realize this only when it’s too late.

Security deposit- A major crisis of Bangalore

Advocate here, Bangalore has an unspoken rental problem that most tenants discover only after vacating the premises.

In my practice, I’ve rarely seen any other city where withholding of security deposits has become so routine—and almost normalized—as it has in Bangalore.

There are cases where an actual damage has been done by tenant to which landlord is entitled to deduct from the security deposit but in most of cases even when there is not even a minor damage to the premises, the landlord willfully refuses and ignores the tenants right to get back the security deposit.m and it looks like unsaid rule among the landlord’s in Bangalore.

Just today, I had to issue a legal notice on behalf of a tenant whose deposit has been illegally withheld for seven months, despite peaceful handover of possession. Interest and legal costs had to be claimed not because the tenant wanted litigation, but because silence was mistaken for surrender.

And this is not kind of rare case but is done on a regular basis.

So as a lawyer i would genuinely advice all the tenants here One practical takeaway for tenants

A rent agreement drafted casually or worse, copied from the internet often costs far more than it saves. Clauses on security deposit, deductions, timelines, and handover are not mere formalities they decide whether your money comes back or disappears.

please get a learned Advocate draft tour rent agreement before getting in the rented premises unless u want to loose the security deposit amount.

Also to those tenants who have been victim of this fraud please do consult an Advocate and send the legal notice asking for the reimbursement of the amount with interest and costs as in most cases due to fear of the consequences and legal procedures the landlords agrees to pay the deposits.

Howcome prostitution is still legal in india

A brief about me is i am an indian male practicing law

And we are having the indian contract act of 1872 made by British, which defines free consent as consent without coercion fraud misrepresentation and undue influence

Any consent which has any of the aforementioned traits is basically not a free consent

Which literally means that prostitution is rape

Though it is true that the the women consents to have sex but her consent is not free but given because of financial hardship or other factors

We are still discussing weather marital rape is rape or not and on the ither hand we have left this prostitution still legal in our nation

How can be this even possible

Though one of the oldest job is prostitution yet i believe now it shall be declared as illegal

Also i believe marital rape accompanied with violence shall be declared illegal

And made punishable in our nation

Tell me your views on both the topics

What is your opinion as women for both of the following?

  1. Marital rape with-and without violence ( keeping in bind the BOP)

  2. Prostitution being still legal

If a person claims to have strong morals but those morals have never been tested, then they are not truly morals; they are only a hypothetical set of standards the person assumes they possess. In my case, I believe myself to be morally upright because I have never engaged in physical or emotional relationships with women. However, the truth is that I have never really been in close proximity to temptation. I have never experienced emotional intimacy, physical closeness, or the warmth of a woman in a way that genuinely tested my self-control. Therefore, my sense of moral correctness may be based more on absence of opportunity than on proven restraint. My morals would be truly validated only if I were placed near real temptation—emotional connection, attraction, and closeness—and still consciously chose restraint for the sake of faith, principles, and discipline over desire. Until such a test occurs, what I call morals may largely be an untested belief about myself rather than a demonstrated ethical strength.

I will try to use minimal words be with me and advise me as a women how to actually get in

I am 24 M lawyer practicing in High court

And i have never been in a relationship although i liked a girl in my school while i was in class 7-8 but i failed to gather courage to tell her and then we both proceeded in our own ways without any communication which is indeed my failure.

But as now i am a practicing lawyer i see in family courts the petition for divorce is getting way higher then it was ever and now to me arranged marriages feel like a gamble if it works fine if not several cases of divorce and maintenance are on way, not too far sometimes even false cases and indeed as every man i want to avoid that

I want a secure relationship with shared values where we both have shared values and are actually compatible with each other.

On the other hand i also believe to some extent if i do not find the love of my life before i get success i might never find her as after success comes attraction and then relating values with women would be more difficult, so i am. Thinking to get my partner before i actually succeed and stand on my feet

But the issue is

I am not looking for any hookups or dating several women rather i am in search of a women who could be the only women in my life and vice verse is indeed preferred

But i dont even know how to get started and how to find such a women

I havent came across such wimen by now

As there are usually lower numbers of women in law field and even less from muslim community.

Any lead m on how to proceed would indeed be appreciated.

My aim is not experimentation but commitment, and I prefer sincerity, loyalty, and simplicity over appearances
