So I'm a former ukipo examiner with 8 years of experience, and a patent consultant with 3 years of experience.

I started looking for a trainee patent attorney job in the uk, but a recruiter told me I face 2 major hurdles. The first is volume of applicants, meaning it's hard for my applications to get noticed out of literally hundreds.

The second is that even though I have a PhD my undergraduate degree was only a 2:2. So I get filtered out as not having a 2:1 or a 1st.

I've been told in Sweden I won't face either of those problems. Is that true?

My prediction for England v Mexico

Like all of you I am hoping Mexico win, but I thought I'd give you my realistic prediction of what will happen.

I think England played well in their first match against Croatia, but since then they haven't been particularly impressive or convincing.

Likewise, Mexico haven't played super well either.

So I'd say there's no clear favourite for this match.

My prediction is 1-1 after extra time with England losing on penalties.

Afterwards, Tuchel gets sacked after an intense media meltdown.

Stuttering or pausing in a run up to a penalty should be banned

I think if the players pause, stop or try to get the goalie to move prior to kicking the ball should be classed as a missed penalty attempt. It should then be turned over to the goalie for a goal kick in normal play or just classed as a miss in a shootout.

If you start your run up you have to complete the run up and kick the ball. No cutesy trickery stuff.

Back in Scotland - Here's the full story

So, now that I'm back in Scotland I can finally share all of the emails and information that I've had from the JKA and my complaints without fear of being sued for defamation. All of the names and personal information has been redacted and anonymised, but other than that you can read all of it here.

The TLDR if you don't want to read it is that I told my instructor I didn't want to participate in a competition. He got angry and started threatening me. I reported him to the police and the JKA. The JKA's response was to ban me for "damaging the organisation".

I've had an email from a patent firm and just wondered what to expect next (UK)

A little bit about my background. I'm a former UKIPO patent examiner with 8 years of experience in computing technology. I specialised particularly in excluded subject matter, mainly computer programs and business methods. I've also been working part-time as a consultant helping out a former colleague with their private consultancy work.

A lot of that is doing things that are broadly similar to what a patent attorney would do. Drafting claims, amending in response to exam reports, advising on the best way to proceed with a given application, that kind of thing.

I've been applying to lots of firms in the UK looking for a trainee patent attorney role. Most of them I didn't even get through to the interview stage, for some reason. However, I got an email from a firm requesting I have a video call with their recruiter.

What was interesting about the email is that it said this:

"The salary for this role is £X let me know if this works for you.

 

I would like to set up a call this week to discuss the role and your experience what time and day works best for you?"

We've set up a call for Thursday, but I'm not sure what to expect in the call or what to expect after that.

Can anyone advise a little bit?

Can a UK martial arts organisation enforce a foreign ban that may relate to disability issues?

I’m looking for UK legal advice regarding a potential discrimination/governance issue involving a martial arts organisation with international branches.

I’m a British citizen with autism who was training with the Taiwan branch of the Japan Karate Association (JKA). During a training course in Taiwan, there was an incident involving an instructor where I felt I was threatened/intimidated in front of others. The matter became serious enough that I made a police report in Taiwan.

After this, a senior instructor from JKA Scotland (where my original membership came from) became involved. He presented himself as an intermediary trying to resolve the situation and encouraged me to drop the police matter. During discussions he told me things such as:

- that I could damage the instructor’s life/career,

- that I might lose my Taiwan Gold Card visa status,

- and that I could effectively lose access to karate in Taiwan.

I eventually withdrew the complaint after being led to believe reconciliation and future training might still be possible.

However, I later received emails from JKA Taiwan / JKA HQ stating that I was permanently excluded from the organisation. One part of the email stated that “regardless of whether the police report or criminal actions are true or not”, my return was impossible because of harm caused to the organisation through the police matter, emails, and online criticism.

The organisation also referenced my autism disclosure in earlier correspondence and at one point suggested my “ideas about karate” differed from theirs.

My understanding is:

- the original exclusion decision was made by JKA Taiwan and/or JKA HQ overseas,

- but JKA Scotland may now be giving practical effect to the exclusion within the UK.

I have documentary evidence including emails and written communications.

My questions are:

  1. Could a UK court realistically have jurisdiction over any part of this dispute?

  2. Could JKA Scotland potentially have liability under the Equality Act 2010 if they enforce or adopt a ban connected to disability-related issues?

  3. Could the conduct of the Scottish instructor potentially create separate liability even though many conversations occurred in Taiwan?

  4. Is this more likely to be a matter for sports governance/regulatory bodies rather than litigation?

  5. What type of solicitor would be most appropriate for an initial consultation (sports law, discrimination law, civil litigation, etc.)?

I’m not asking whether the ban itself was “fair”, but whether there may realistically be a legal issue within UK jurisdiction worth exploring further.

I finished a stream earlier today then went to sleep. I woke up later sat down at my computer and had some "me" time. Then I opened up OBS and saw that I was live and I had messages and things in my chat.

Naturally, I turned the stream off immediately and deleted the vod, but the stream had like 10 views and I had no idea it was even live.

Nothing explicit was shown on stream, thankfully, but I still feel mortified about it and I'm worried about potential consequences.

Also, I've genuinely no idea how my stream went live since my previous vod was me literally turning thes stream off.

So it's been confirmed by JKA HQ that I am banned from the organisation as a whole, primarily for reporting my instructor to the police for crimes that if he were convicted of could potentially result in up to the 3 years in prison.

I told the head of my local JKA organisation here, and his statement, which came from JKA HQ was that that makes my return impossible, i.e. the severity of the crime is directly linked to the severity of my ban.

This makes me seriously question whether the JKA should be allowed to operate in any European countries at all, given that anyone who reports a crime is at risk of a ban. Imagine if children were being abused and the parents, or the child themselves reported it? Banned.

It's a chilling effect. What's worse is that I'm a disabled member who got threatened and intimidated by a senior instructor, reported it in good faith to the proper authorities and got a global lifetime ban for it.

The JKA said that what I did "harmed the organisation and individuals within it". That's their attitude. Reporting crimes harms the organisation. Therefore, the victim and reportee is the one that gets the banned, not the person who committed the crime.

I would also add that the JKA are monitoring my posts and took steps to identify me, despite my posts being anonymous. I also posted comparing the grading standards in my home country vs the country I'm currently living in and quoted facts I was given by an instructor there. They also took steps to identify who that instructor was and pressured him to cease contact with me. He even told me that simply talking to me was "getting involved" and refused to talk to me further.

They even said as part of the ban that my "online criticism" made it clear that my understanding of karate differs from theirs and so I can't be accepted back into the organisation.

I think it's extremely dangerous that they behave this way, and they should be deaffiliated and banned from operating in any country outside of Japan, because there are serious question marks about member safety, especially for children.
