England - Potential Civil Penalty From JSA?
I'm in England, I lost my job last year and lived on savings until 12th March this year. On 12th March I submitted claims for Universal Credit and Jobseeker's allowance. Both were being paid according to their schedules (JSA every 2 weeks, UC every month). When attending Jobcentre for my first JSA appointment they said that I would only need to meet with my UC work coach and that the UC work coach should keep JSA updated with any updates to my status. On 25th May I started a self employed job (40hrs a week). On the 28th May I sent a message in my UC journal saying:
>Hello, I have started self employed taxi driving this week (Monday 25th May). I am not sure where to update this to ensure everyone (UC/ JSA) is made aware or what the next steps are regarding UC claim etc.
They replied:
>You will need to report a change of circumstances in your UC account under work and earnings, put yourself as self employed and then we will book you a Gateway appointment to go through everything with you. This appointment is usually an hour long.
To me, the above exchange meant that I had informed both UC and JSA of my new job.
On 4th June I received a payment from JSA which I assumed was just any remaining payout I was eligible for.
On 16th June I had a phone call from JSA at my local Jobcenter checking up on my claim as they were saying it was still active. I told them about my new job and they said that I'd likely receive a civil penalty as I didn't inform them of my new circumstances soon enough and had accepted an overpayment. I told them what UC had said and they said that didn't matter and the penalty was still likely.
I've since received another payment from JSA on 18th June.
I'm not sure what to do here, I know I need to pay back the over payments but I don't think that I should be liable for the civil penalty when I was told by UC that all I needed to do was update them.
