A trademark troll filed a bad faith claim against my small fan merch store and Wix took my entire site down. 48+ hours later, still no response.

I’ve been running Ruckus Tees (ruckustees.com) for 9 years as a small independent fan merch operation — limited runs of t-shirts, pins, patches, and stickers inspired by 80s pop culture. I sell maybe 40-50 shirts per run, a labor of love more than a business.

A few days ago I received a “Notice of Claimed Intellectual Property Infringement” from a third party claiming I was infringing on their FILMATION®, LJN®, and GALOOB® trademarks.

Here’s the problem — after speaking with an IP lawyer the claim is deeply flawed:

The trademark is on the Supplemental Register, not the Principal Register. This is the weakest form of trademark protection in the US. It carries no presumption of validity and provides significantly limited rights. (USPTO Reg. No. 5,425,411)

The registration only covers Class 25 goods — shirts, shorts, and shoes. Yet the notice targeted my pins, patches, stickers, and flasks, which fall entirely outside that registered class. The claimant then signed a good faith statement under penalty of perjury claiming rights over those products. That’s a knowingly false declaration.

The registered mark is a very specific composite logo — a ghost image combined with the word FILMATION beneath it. My designs don’t include the word FILMATION at all.
The claimant doesn’t even own the underlying IP. The actual Filmation intellectual property is owned by DreamWorks Animation via DreamWorks Classics (NBCUniversal/Comcast). 80sTees.com sells officially licensed Filmation merchandise — licensed from DreamWorks, not from this claimant.

Despite all of this, the notice was filed with Wix, and Wix took my entire storefront offline without any meaningful review of the claim’s validity.
I immediately complied with their removal request to get my site back up — I’m in the middle of an active timed sales run that closes on the 14th. I sent a detailed counter-notice explaining exactly why the claim was invalid.

That was over 48 hours ago. My site is still down. Wix’s only response has been “it’s with our experts.”

I’ve been a paying Wix customer for 9 years. This is how they handle a bad faith claim against a small creator.

The lesson here for anyone running a small merch operation: platforms will fold immediately to any IP complaint regardless of merit, and you’ll be left scrambling while a trademark troll faces zero consequences for filing false claims under penalty of perjury.

Currently in the process of migrating away from Wix entirely. Looking at Shopify or Big Cartel for anyone who has recommendations.

TL;DR: A third party with a weak Supplemental Register mark filed a bad faith claim against my 9-year small fan merch store. Wix took my whole site down. 48+ hours later, still no response despite full compliance with their removal request.

Made a shirt for the Filmations Ghostbusters fans — you know, the OTHER Ghostbusters

Before the proton packs and the slime there was a completely different ghost-busting crew — Jake, Eddie, and Tracy the Gorilla. The Filmations Ghostbusters cartoon actually predates the 1984 film and the whole naming rights situation between the two is genuinely fascinating.

I run a small merch shop and finally did a proper tribute tee to the Filmations logo. It's been on my list for years and I'm really happy with how it came out.
