Well, in Nepal, it's not. Being "unmarried" and "not married" is not different.

I had a client who wanted to do Court Marriage and when he made his "Marital Status Certificate" from the ward office, it was written that "..... Applicant is not married".

However when we went to the Consular Department of the Ministry of Foreign Affairs to verify it to send it abroad, they said that it must be written "unmarried" instead of "not married".

Good News for Tech Entrepreneurs

The Office of Company Registrar (OCR) has reached an agreement with Inland Revenue Department (IRD) with regards to generation of PAN Number of Company within the CAMIS system operated by OCR.

It simply means, while you register your new company, you'll get the PAN number too. No need to apply again at IRD and get one.

Exemption of Fines by Office of Company Registrar

The Office of Company Registrar (OCR) is exempting fines for every company.

YESS, You heard that right.

If you had registered a company and hadn't updated it yearly, the OCR must have fined you some amount of money depending on your company's capital.

These fines are now exempted and you can do two things

  1. either close the company.

  2. renew the company.

Chef Santosh Shah Case Update

What actually happened to chef Santosh Shah? Why was he arrested?

​

Chef Santosh Shah was arrested last Friday from Mahottari and brought to Kathmandu on Saturday for investigation. He was accused of issuing a cheque which bounced since he did not have the said amount in his bank account.

​

Chef Shah issued multiple cheques but he did not have sufficient funds in his bank, hence the CHEQUE BOUNCED.

​

The act of bouncing of cheque is a crime under the Banking Offence and Punishment Act, 2064 .

​

It doesn't matter if you have given that cheque as security, or you have issued a blank cheque, or if you had past transactions or not with the other person.

​

NOTHING MATTERS EXCEPT YOUR SIGNATURE ON THE CHEQUE.

​

If you signed it, and you do not have sufficient money in the bank account, it gets bounced. You're in legal trouble.

​

After paying the amount, he has recently been released.

Divorce Process Reality in Nepal 🇳🇵

Im a lawyer based in Kathmandu and I get tired and annoyed by few of my clients opposition who say "Send me divorce papers, I'll sign".

NOOOO, court cases and its procedures do not happen like that. Its totally different from what they show in movies and series.

​

In Nepal, we do not have the concept of "Two People Signing the Divorce Papers". For some reasons, I don't know why, it happens in quiet different way.

​

  1. First, either the girl or the guy files a divorce case in the concerned district court citing some grounds.

​

  1. Second, the opposition files a reply and gets connected to the case.

​

  1. Thirdly, despite the ongoing case filed above, both the male and female file a joint petition to dissolve their marriage with consent.

​

  1. Fourthly, they both appear in court and finally the consented divorce takes place.

​

So What can we see from above practice?

​

  1. You or your power of attorney must appear before the court for divorce.

​

  1. It takes 2 days to conclude a mutually consented divorce in Nepal.

​
