Tennessee. As far as my understanding of the Constitution, even condemned criminals are protected by the 8th Amendment, which reads:

"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

Would the psychological trauma of being executed more than once and repeated failed executions not be considered cruel and unusual?

Magneto is a Holocaust survivor. His motivations have always been centered around those experiences and wanting mutants to avoid that fate. Removing that element completely changes Magneto into a different character.

Enter the MCU’s problem. Having your character tied to a major historical event has the unfortunate consequence of aging them. The youngest Holocaust survivor would be 82 years old. That simply won’t work if you are introducing new characters into the MCU in 2028. The MCU is set in modern time, slightly ahead due to the blip, and the casting of other characters like Jean Grey shows that they are doing a reset.

The only way you can keep the motivations of Magneto in 2028 and not have him be pushing 90 is to have him be a survivor of a different, more recent, genocide.

Narratively the best alternative would be for Magneto to be a survivor of the Bosnian War from 1992-1995 in which a genocide and ethnic cleansing took place. This has the dual effect of allowing the character to be as young as 45 and keeping the European genocide element of his backstory.

I’m glad the reception at the box office showed that the backlash online against the racial diverse casting in the Odyssey was much to do about nothing. I wonder if Nolan’s next film centered around a female lead, would there also be this backlash? Even if there was I doubt it would affect people from going.

The two most obvious choices for a lead actress in a Nolan film would be Anne Hathaway and Marion Cotillard but he could throw a curve ball and hire and actress he’s never worked with to lead his film like he did with Tenet.
