Joshi v. Canada is a good example of how people can dress up their position to qualify for things they shouldn't be

This recently decided case was the result of a Rogers retail store employee applying and receiving a nomination for PR under the Canadian Experience Class. The Canadian Experience Class takes into account Canadian experience in skilled roles. The individual states that they are a Wholesale Technical Sales Specialist while working a retail position. The officer rejected this and stated that they are a Retail Salesperson which is not a skilled NOC and ultimately rejected their PR application.

However, the judge ruled that the officer did not provide sufficient justification as their notes are vague and do not address that the Wholesale Technical Sales Specialist NOC has duties that would be covered by the position and that they did not consider that some of the illustrative job titles of this NOC mention telecommunications equipment. Therefore, IRCC must now reconsider their application.

This is a really good example of how when there are multiple NOCs that have vague definitions that people can game them for their own benefit. I saw this when I was looking at CEO level roles which were given 200 extra points for having a positive LMIA and now has its own draw where people can get picked for PR with much lower scores than other draws. I found a lot of businesses that seemed like they would not have a CEO level role like a single daycare or shoe store. Since the job duties talk about managing departments and finances, they can argue that it is the correct NOC. They can dress up low skilled work to be highly skilled by picking apart wording.

Clearly, a Rogers store worker is not a skilled position and not something that we should be giving PR for.

I have attached the LMIA history of B4U Construction and B4U 13 Construction showing extensive use of the LMIA system.

The employer is in construction so would be able to file a LMIA under the Low-Wage Stream but the wage offered is the exact wage needed to qualify for the High-Wage Stream. They would be subject to a 20% cap of employees being on Low-Wage LMIAs and it looks like most if not all employees are TFWs.

The wage is interesting because the median wage to qualify for the High-Wage Stream in Manitoba is $30.16 per hour. Since the wage offered is slightly above that the LMIA is not subject to a refusal to process when the unemployment rate in Winnipeg is above 6%.

I looked on the corporate careers site and did not find the position listed. I found a post on LinkedIn about it but it said that they are no longer accepting applicants.

A look at Indeed showed no signs of the job posting but another location in Winnipeg had similar roles listed with a wage offer of $19 to $22 per hour.

Clarifying my position on not harassing people

I have posted a lot of information on businesses that have filed for LMIAs using public information like the Job Bank postings. The purpose of this is to shed light on usage of the program and I have a particular interest in businesses that post ads for jobs that would typically be low-wage but they post it at or slightly above the median wage to qualify for the High-Wage Stream of the program.

I am not trying to accuse anyone of wrongdoing as I have not got their side of the story to draw a strong conclusion and I am not an investigator and have no association with the program or the government. I'm just a private citizen with a bit of a weird interest in looking into this. I am in no way encouraging anyone to harass or intimidate people that may be involved with the businesses. I strongly discourage anyone from doing anything that could be considered illegal or threatening.

That being said, if you feel that something is amiss you have the right to report the listing to Job Bank and the TFW Program for potential misuse. I encourage people to apply to jobs they are qualified for and interested in. You and I have the right to talk about these postings as they are public and posted on a federal government website. There is no expectation that the business owner can keep this information private and keep us from talking about it because it embarrasses them. If you want to reach out to the owner in a non-harassing threatening way and politely share your concerns or stop patronizing the businesses that is completely up to you. I am not encouraging you to do that but you are free to make your own decisions.

You are free to use anything I have posted without giving me credit. This is not to encourage you to harass anyone, but that I don't mind you taking your information for your own purposes since most of it is public information except the words I wrote. Previously this location which appears to be owned by a company called Patel Foods hired a Bookkeeper in 2022 likely through the LMIA program because it was posted on one of the bogus sites used for that program. They also posted an advertisement for a HR Specialist paid $39 per hour in 2026.

Also found on Job Bank is a posting for a Food Counter Attendant for this same location where it states that you can apply in-person in a different town but not at the restraurant itself. No LMIA has been filed for this as of August 6.

While I am confused why a Subway needs an Administrative Manager with the duties mentioned, I am also confused at how much profit this Subway makes to afford all these positions and have a full-time Bookkeeper and HR member on staff. I have been completely misled about how much cash Subways must make.
