Justice Clarence Thomas once again called on the Supreme Court to reconsider its 1964 ruling in New York Times Co. v. Sullivan, the decision that established the "actual malice" standard and fundamentally reshaped American defamation law. The dissent came Monday when the Court declined to hear Dershowitz v. Cable News Network, a $300 million defamation case brought by retired Harvard law professor Alan Dershowitz stemming from CNN's coverage of Trump's first Senate impeachment trial. Justices Thomas and Gorsuch both dissented, but no other member of the Court has shown interest in revisiting Sullivan, and overturning the precedent would require at least five votes. Thomas has been making this argument since at least 2019, and analysts note the repeated cert denials suggest a majority is simply not interested in reopening the question.
